Hadith 4059
قُرِئَ عَلَى أَبِي الْقَاسِمِ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ، وَأَنَا أَسْمَعُ ، حَدَّثَكُمْ مُحَمَّدُ بْنُ عَبَّادٍ الْمَكِّيُّ أَبُو عَبْدِ اللَّهِ ، قِرَاءَةً عَلَيْهِ ، فِي رَجَبٍ سَنَةَ ، إِحْدَى وَثَلاثِينَ وَمِائَتَيْنِ ، نَا حَفْصُ بْنُ عُمَرَ بْنِ أَبِي الْعَطَّافِ ، عَنْ أَبِي الزِّنَادِ ، عَنِ الأَعْرَجِ ، عَنْ أَبِي هُرَيْرَةَ ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " تَعَلَّمُوا الْفَرَائِضَ ، وَعَلِّمُوهَا النَّاسَ فَإِنَّهُ نِصْفُ الْعِلْمِ ، وَهُوَ أَوَّلُ شَيْءٍ يُنْسَى ، وَهُوَ أَوَّلُ شَيْءٍ يُنْتَزَعُ مِنْ أُمَّتِي " .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: “Learn the knowledge of inheritance and teach it to the people, for it is half of knowledge, and it is the first thing that will be forgotten, and it is the first thing that will be taken away from my Ummah.”
Hadith 4060
نَا عَبْدُ اللَّهِ بن مُحَمَّدِ بْنِ زِيَادٍ ، عن ، نَا بَحْرُ بْنُ نَصْرٍ ، نَا ابْنُ وَهْبٍ ، نَا عَبْدُ الرَّحْمَنِ بْنُ زِيَادِ بْنِ أَنْعَمَ الإِفْرِيقِيُّ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ رَافِعٍ التَّنُوخِيِّ ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ الْعَاصِ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " الْعِلْمُ ثَلاثَةٌ وَمَا سِوَى ذَلِكَ فَهُوَ فَضْلٌ : آيَةٌ مُحْكَمَةٌ ، أَوْ سُنَّةٌ قَائِمَةٌ ، أَوْ فَرِيضَةٌ عَادِلَةٌ " .
Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said: “Knowledge is of three types, and whatever is besides that is extra: the knowledge of firm (clear) verses, the knowledge of the just Sunnah, and the knowledge of the laws of inheritance according to justice.”
Hadith 4061
نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ، نَا كَامِلُ بْنُ طَلْحَةَ ، نَا ابْنُ لَهِيعَةَ ، نَا عِيسَى بْنُ لَهِيعَةَ ، عَنْ عِكْرِمَةَ ، قَالَ : سَمِعْتُ ابْنَ عَبَّاسٍ ، يَقُولُ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ " بَعْدَمَا أنزلت سُورَةُ النِّسَاءِ ، وَفُرِضَ فِيهَا الْفَرَائِضُ ، يَقُولُ : لا حَبْسَ بَعْدَ سُورَةِ النِّسَاءِ " .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates that I heard the Noble Prophet (peace and blessings be upon him) saying this after Surah An-Nisa was revealed and the rulings of inheritance were revealed in it. He (peace be upon him) said: "After Surah An-Nisa, no one can be kept from inheritance."
Hadith 4062
نَا عُبَيْدُ اللَّهِ بْنُ عَبْدِ الصَّمَدِ بْنِ الْمُهْتَدِي بِاللَّهِ ، نَا مُحَمَّدُ بْنُ عَبْدِ الرَّحِيمِ بْنِ مُوسَى الصَّدَفِيُّ ، بِمِصْرَ ، نَا عَمْرُو بْنُ خَالِدٍ ، نَا ابْنُ لَهِيعَةَ ، عَنْ أَخِيهِ عِيسَى بْنِ لَهِيعَةَ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا حَبْسَ عَنْ فَرَائِضِ اللَّهِ عَزَّ وَجَلَّ " ، لَمْ يُسْنِدْهُ غَيْرُ ابْنِ لَهِيعَةَ ، عَنْ أَخِيهِ ، وَهُمَا ضَعِيفَانِ.
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates that the Noble Prophet (peace and blessings be upon him) said: "No one can be prevented from the shares of inheritance prescribed by Allah." No one besides Ibn Lahi'ah has narrated this chain; he has transmitted it from his brother. Both of these narrators are weak.
Hadith 4063
نَا نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ، نَا مُحْرِزُ بْنُ عَوْنٍ ، نَا شَرِيكٌ ، عَنْ أَبِي إِسْحَاقَ ، عَنِ الْحَارِثِ ، عَنْ عَلِيٍّ ، " فِي ابْنَتَيْنِ ، وَأَبَوَيْنِ ، وَامْرَأَةٍ ، قَالَ : صَارَ ثَمَنُهَا تِسْعًا " .
Sayyiduna Ali (may Allah be pleased with him) said regarding (the deceased's) two daughters, mother, father, and wife: "His inheritance will be divided into nine shares."
Hadith 4064
نَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ بْنِ مُحَمَّدٍ وَكِيلُ أَبِي صَخْرَةَ ، نَا عَلِيُّ بْنُ حَرْبٍ ، نَا الْحَسَنُ بْنُ مُوسَى ، نَا عُمَرُ بْنُ رَاشِدٍ . ح وَنا الْحُسَيْنُ بْنُ يَحْيَى بْنِ عَيَّاشٍ ، نَا الْحَسَنُ بْنُ مُحَمَّدٍ الزَّعْفَرَانِيُّ ، نَا عَلِيُّ بْنُ الْجَعْدِ ، أنا عُمَرُ بْنُ رَاشِدِ بْنِ شَجَرَةَ ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ ، عَنْ أَبِي سَلَمَةَ ، عَنْ أَبِي هُرَيْرَةَ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لا تَرِثُ مِلَّةٌ مِلَّةً ، وَلا يَجُوزُ شَهَادَةُ أَهْلِ مِلَّةٍ عَلَى مِلَّةٍ إِلا أُمَّتِي ، فَإِنَّهُمْ يَجُوزُ شَهَادَتُهُمْ عَلَى مَنْ سِوَاهُمْ " ، لَفْظُ ابْنِ عَيَّاشٍ ، إِلا أَنَّهُ قَالَ فِي حَدِيثِهِ ، عَنْ أَبِي هُرَيْرَةَ : أَحْسَبُ شَكَّ عُمَرُ ، وَعُمَرُ بْنُ رَاشِدٍ لَيْسَ بِالْقَوِيِّ.
Sayyiduna Abu Huraira (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "A follower of one religion does not inherit from a follower of another religion, and the testimony of people belonging to one religion is not accepted against those of another religion. However, the ruling for my Ummah is different, because their testimony will be accepted in favor of all other people." These are the words of the narrator named 'Ayyash; however, he has mentioned in his narration: "I think that the doubt regarding the wording of the narration is with the narrator named 'Umar, and the narrator named 'Umar is 'Umar bin Rashid, who is not reliable."
Hadith 4065
نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا بَحْرُ بْنُ نَصْرٍ ، نَا ابْنُ وَهْبٍ ، أَخْبَرَنِي يُونُسُ ، أَخْبَرَنِي ابْنُ شِهَابٍ ، عَنْ عَلِيِّ بْنِ الْحُسَيْنِ ، عَنْ عَمْرِو بْنِ عُثْمَانَ ، عَنْ أُسَامَةَ بْنِ زَيْدٍ ، عَن النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لا يَرِثُ الْكَافِرُ الْمُسْلِمَ ، وَلا الْمُسْلِمُ الْكَافِرَ " .
Sayyiduna Usama bin Zaid (may Allah be pleased with them both) narrates this statement of the Noble Prophet (peace and blessings be upon him): "No disbeliever can inherit from a Muslim, and no Muslim can inherit from a disbeliever."
Hadith 4066
نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ، نَا دَاوُدُ بْنُ رُشَيْدٍ ، نَا عَمْرُو بْنُ عَبْدِ الْوَاحِدِ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ يَزِيدَ بْنِ جَابِرٍ ، نَا سَعِيدُ بْنُ أَبِي سَعِيدٍ ، عَنْ أَنَسِ بْنِ مَالِكٍ ، قَالَ : " إِنِّي لَتَحْتَ نَاقَةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَسِيلُ عَلَيَّ لُعَابُهَا فَسَمِعْتُهُ ، يَقُولُ : إِنَّ اللَّهَ عَزَّ وَجَلَّ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ فَلا وَصِيَّةَ لِوَارِثٍ ، وَالْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ ، لا يَدَّعِينَ رَجُلٌ إِلَى غَيْرِ أَبِيهِ ، وَلا يَنْتَمِي إِلَى غَيْرِ مَوَالِيهِ ، فَمَنْ فَعَلَ ذَلِكَ فَعَلَيْهِ لَعْنَةُ اللَّهِ مُتَتَابِعَةً ، لا تُنْفِقُ الْمَرْأَةُ شَيْئًا مِنْ بَيْتِ زَوْجِهَا إِلا بِإِذْنِهِ ، فَقَالَ رَجُلٌ : وَلا الطَّعَامَ يَا رَسُولَ اللَّهِ ؟ ، قَالَ : ذَاكَ أَفْضَلُ أَمْوَالِنَا ، ثُمَّ قَالَ : أَلا إِنَّ الْعَارِيَةَ مُؤَدَّاةٌ ، وَالدَّيْنَ مَقْضِيٌّ ، وَالزَّعِيمُ غَارِمٌ " ،.
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates: I was standing under the camel of the Prophet (peace and blessings be upon him), and its saliva was dripping on me. On that occasion, he said: "Allah has appointed the due right of every rightful person, so no bequest can be made in favor of an heir. The child will belong to the (marital) bed, and the adulterer will be deprived. No one should be called by reference to anyone other than his (biological) father, and no one should attribute himself to anyone other than his emancipator. Whoever does so, upon him is the continuous curse of Allah. A woman should not spend anything from her husband's house without his permission." A man asked: "O Messenger of Allah! Not even food grain?" The Prophet (peace and blessings be upon him) said: "That is our most important wealth." Then after that, the Prophet (peace and blessings be upon him) said: "A borrowed item must be returned, a loan must be repaid, and whoever assumes responsibility will also be liable to pay compensation."
Hadith 4067
نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا عَبَّاسُ بْنُ الْوَلِيدِ بْنِ مَزْيَدٍ ، أَخْبَرَنِي أَبِي ، نَا عَبْدُ الرَّحْمَنِ بْنُ يَزِيدَ بْنِ جَابِرٍ ، حَدَّثَنِي سَعِيدُ بْنُ أَبِي سَعِيدٍ ، شَيْخٌ بِالسَّاحِلِ ، قَالَ : حَدَّثَنِي رَجُلٌ مِنْ أَهْلِ الْمَدِينَةِ ، قَالَ : إِنِّي لَتَحْتَ نَاقَةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَذَكَرَ نَحْوَهُ.
In another narration, the same words are present. Sayyiduna Anas (may Allah be pleased with him) says: "I stood beneath the camel of the Prophet (peace and blessings be upon him)." After that, he narrated as in the previous narration.
