Hadith 3874
نَا نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ، نَا دَاوُدُ بْنُ عَمْرٍو ، نَا دَاوُدُ الْعَطَّارُ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ جَمِيلَةَ بِنْتِ سَعْدٍ ، قَالَتْ : قَالَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا : " مَا تَزِيدُ الْمَرْأَةِ فِي الْحَمْلِ عَلَى سَنَتَيْنِ قَدْرَ مَا يَتَحَوَّلُ ظِلُّ عُودِ الْمِغْزَلِ " .
Sayyidah Aisha (may Allah be pleased with her) said: "No woman's pregnancy can remain in her womb for more than two years, even if it changes only as much as the shadow of a spindle's wood."
Hadith 3875
نَا نَا دَعْلَجُ بْنُ أَحْمَدَ ، نَا الْحَسَنُ بْنُ سُفْيَانَ ، نَا حَبَّانُ ، ثنا ابْنُ الْمُبَارَكِ ، أنا دَاوُدُ بْنُ عَبْدِ الرَّحْمَنِ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ جَمِيلَةَ بِنْتِ سَعْدٍ ، عَنْ عَائِشَةَ ، قَالَتْ : " لا يَكُونُ الْحَمْلُ أَكْثَرَ مِنْ سَنَتَيْنِ قَدْرَ مَا يَتَحَوَّلُ ظِلُّ الْمِغْزَلِ " ، وَجُمَيْلَةُ بِنْتُ سَعْدٍ ، أُخْتُ عُبَيْدِ بْنِ سَعْدٍ.
Sayyida Aisha (may Allah be pleased with her) said: "No woman's pregnancy can remain in her womb for more than two years, even if it changes as much as a spindle stick." A woman named Jameela bint Sa'd is the sister of Ubaid bin Sa'd.
Hadith 3876
نَا نَا مُحَمَّدُ بْنُ نُوحٍ الْجُنْدِيسَابُورِيُّ ، نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ يَحْيَى بْنِ سَعْدٍ ، نَا ابْنُ نُمَيْرٍ ، نَا الأَعْمَشُ ، عَنْ أَبِي سُفْيَانَ ، قَالَ : حَدَّثَنِي أَشْيَاخٌ مِنَّا ، قَالُوا : جَاءَ رَجُلٌ إِلَى عُمَرَ بْنِ الْخَطَّابِ ، فَقَالَ : يَا أَمِيرَ الْمُؤْمِنِينَ ، " إِنِّي غِبْتُ عَنِ امْرَأَتِي سَنَتَيْنِ فَجِئْتُ وَهِيَ حُبْلَى ، فَشَاوَرَ عُمَرُ النَّاسَ فِي رَجْمِهَا ، قَالَ : فَقَالَ مُعَاذُ بْنُ جَبَلٍ : يَا أَمِيرَ الْمُؤْمِنِينَ ، إِنْ كَانَ لَكَ عَلَيْهَا سَبِيلٌ فَلَيْسَ لَكَ عَلَى مَا فِي بَطْنِهَا سَبِيلٌ ، فَاتْرُكْهَا حَتَّى تَضَعَ ، فَتَرَكَهَا فَوَلَدَتْ غُلامًا قَدْ خَرَجَتْ ثَنَيَاهُ فَعَرَفَ الرَّجُلُ الشَّبَهَ فِيهِ ، فَقَالَ : ابْنِي وَرَبِّ الْكَعْبَةِ ، فَقَالَ عُمَرُ عَجَزَتِ النِّسَاءُ أَنْ يَلِدْنَ مثل مُعَاذٍ لَوْلا مُعَاذٌ هَلَكَ عُمَرُ " .
A narrator named Abu Sufyan reports: Some of our elders have narrated this: A man came to Sayyiduna Umar ibn al-Khattab (may Allah be pleased with him) and said, "O Commander of the Faithful! I returned to my wife after two years, and she was pregnant." Sayyiduna Umar (may Allah be pleased with him) consulted the people about stoning the woman, so Sayyiduna Mu'adh ibn Jabal (may Allah be pleased with him) said, "O Commander of the Faithful! You can punish the woman, but you cannot punish the child in her womb, so leave her until she gives birth." Sayyiduna Umar (may Allah be pleased with him) left her, and she gave birth to a boy whose front teeth protruded outward, as a result of which the man realized the resemblance of the child to himself. He said, "By the Lord of the Ka'bah! This is my son." So Sayyiduna Umar (may Allah be pleased with him) said, "Women have become incapable of giving birth to a child like Mu'adh. If it were not for Mu'adh, Umar would have perished."
Hadith 3877
نَا نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا أَبُو الْعَبَّاسِ أَحْمَدُ بْنُ مُحَمَّدِ بْنِ بَكْرِ بْنِ خَالِدٍ ، نَا دَاوُدُ بْنُ رُشَيْدٍ ، قَالَ : سَمِعْتُ الْوَلِيدَ بْنَ مُسْلِمٍ ، يَقُولُ : قُلْتُ لِمَالِكِ بْنِ أَنَسٍ : إِنِّي حُدِّثْتُ عَنْ عَائِشَةَ ، أَنَّهَا قَالَتْ : " لا تَزِيدُ الْمَرْأَةُ فِي حَمْلِهَا عَلَى سَنَتَيْنِ قَدْرَ ظِلِّ الْمِغْزَلِ ، فَقَالَ : سُبْحَانَ اللَّهِ مَنْ يَقُولُ هَذَا ؟ هَذِهِ جَارَتُنَا امْرَأَةُ مُحَمَّدِ بْنِ عَجْلانَ امْرَأَةُ صِدْقٍ وَزَوْجُهَا رَجُلُ صِدْقٍ ، حَمَلَتْ ثَلاثَةَ أَبْطُنٍ فِي اثْنَتَيْ عَشْرَةَ سَنَةً ، تَحْمِلُ كُلَّ بَطْنٍ أَرْبَعَ سِنِينَ " .
Waleed bin Muslim narrates: I said to Imam Malik: I have been told regarding Sayyida Aisha (may Allah be pleased with her) that she said: "A woman can be pregnant for up to two years, as long as the shadow of a spindle." So Imam Malik said: "Subhan Allah! How can anyone say such a thing? This girl of ours, who is the wife of Muhammad bin Ajlan, she is a pious woman, and her husband is also a pious man. She has given birth to three children in twelve years, each of whom remained in their mother's womb for four years."
Hadith 3878
نَا عَلِيُّ بْنُ مُحَمَّدِ بْنِ عُبَيْدٍ ، نَا ابْنُ أَبِي خَيْثَمَةَ ، نَا ابْنُ أَبِي رِزْمَةَ . ح وَنا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا الْحُسَيْنُ بْنُ شَدَّادِ بْنِ دَاوُدَ الْمَخْرَمِيُّ ، نَا مُحَمَّدُ بْنُ عَبْدِ الْعَزِيزِ بْنِ أَبِي رِزْمَةَ ، نَا أَبِي ، نَا الْمُبَارَكُ بْنُ مُجَاهِدٍ ، قَالَ : " مَشْهُورٌ عِنْدَنَا كَانَتِ امْرَأَةُ مُحَمَّدِ بْنِ عَجْلانَ تَحْمِلُ وَتَضَعُ فِي أَرْبَعِ سِنِينَ ، وَكَانَتْ تُسَمَّى حَامِلَةَ الْفِيلِ " .
Mubarak bin Mujahid narrates: It is well-known among us that the wife of Muhammad bin Ajlan would give birth to children after being pregnant for four years; this woman was called "Hamilat al-Feel."
Hadith 3879
نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا أَبُو شُعَيْبٍ صَالِحُ بْنُ عِمْرَانَ الدَّعَّاءُ ، حَدَّثَنِي أَحْمَدُ بْنُ غَسَّانَ ، نَا هَاشِمُ بْنُ يَحْيَى الْفَرَّاءُ الْمُجَاشِعِيُّ ، قَالَ : بَيْنَمَا مَالِكُ بْنُ دِينَارٍ يَوْمًا جَالِسًا ، إِذْ جَاءَهُ رَجُلٌ ، فَقَالَ : يَا أَبَا يَحْيَى ، " ادْعُ لامْرَأَةٍ حُبْلَى مُنْذُ أَرْبَعِ سِنِينَ ، قَدْ أَصْبَحَتْ فِي كَرْبٍ شَدِيدٍ فَغَضِبَ مَالِكٌ وَأَطْبَقَ الصُّحُفَ ، فَقَالَ : مَا يَرَى الْقَوْمُ إِلا أَنَّا أَنْبِيَاءُ ، ثُمَّ قَرَأَ ، ثُمَّ دَعَا ، ثُمَّ قَالَ : اللَّهُمَّ هَذِهِ الْمَرْأَةُ إِنْ كَانَ فِي بَطْنِهَا رِيحٌ فَأَخْرِجْهُ عَنْهَا السَّاعَةَ ، وَإِنْ كَانَ فِي بَطْنِهَا جَارِيَةٌ فَأَبْدِلْهَا بِهَا غُلامًا ، فَإِنَّكَ تَمْحُو مَا تَشَاءُ وَتُثْبِتُ ، وَعِنْدَكَ أُمُّ الْكِتَابِ ، ثُمَّ رَفَعَ مَالِكٌ يَدَهُ وَرَفَعَ النَّاسُ أَيْدِيَهُمْ ، وَجَاءَ الرَّسُولُ إِلَى الرَّجُلِ ، فَقَالَ : أَدْرِكِ امْرَأَتَكَ فَذَهَبَ الرَّجُلُ فَمَا حَطَّ مَالِكٌ يَدَهُ ، حَتَّى طَلَعَ الرَّجُلُ مِنْ بَابِ الْمَسْجِدِ عَلَى رَقَبَتِهِ غُلامٌ جَعْدٌ قَطَطٌ ، ابْنُ أَرْبَعِ سِنِينَ ، قَدِ اسْتَوَتْ أَسْنَانُهُ مَا قُطِعَتْ سُرَارُهُ " .
Hashim bin Yahya narrates: Once Malik bin Dinar was sitting, when a man came to him and said, "O Abu Yahya! Pray for this woman who has been pregnant for four years and is in severe pain." Malik bin Dinar became angry, closed the Mushaf, and said, "These people think we are prophets." Then he recited some verses, then prayed and said, "O Allah! If there is air in the woman's womb, then remove it now, and if there is a girl in her womb, then change her into a boy, for You can erase whom You will and keep whom You will; the Mother of the Book is with You." Then Malik bin Dinar raised his hands, and the people also raised their hands. Meanwhile, a messenger came to that man and said, "Go to your wife." The man left, and before Malik bin Dinar had lowered his hands, the man entered through the door of the mosque carrying a child in his arms, who had curly hair, was about four years old, had all his teeth, but his umbilical cord had not been cut.
Hadith 3880
نَا الْقَاسِمُ بْنُ إِسْمَاعِيلَ ، نَا الْعَبَّاسُ بْنُ مُحَمَّدٍ ، نَا مُحَمَّدُ بْنُ مُصْعَبٍ ، قَالَ : سَمِعْتُ الأَوْزَاعِيَّ ، يَقُولُ : " عِنْدَنَا هَاهُنَا امْرَأَةٌ تَحِيضُ غُدْوَةً ، وَتَطْهُرُ عَشِيَّةً " .
Al-Awza'i says: There is a woman among us who gets her menses in the morning and becomes pure in the evening.
Hadith 3881
نَا عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ ، نَا إِسْمَاعِيلُ بْنُ مَحْمُودٍ النَّيْسَابُورِيُّ ، حَدَّثَنِي عُمَرُ بْنُ الْمُتَوَكِّلِ ، حَدَّثَنِي أَحْمَدُ بْنُ مُوسَى الضَّبِّيُّ ، حَدَّثَنِي عَبَّادُ بْنُ عَبَّادٍ الْمُهَلَّبِيُّ ، قَالَ : " أَدْرَكْتُ فِينَا يَعْنِي الْمَهَالِبَةَ امْرَأَةً صَارَتْ جَدَّةً ، وَهِيَ بِنْتُ ثَمَانِ عَشْرَةَ سَنَةً ، وَلَدَتْ لِتِسْعِ سِنِينَ ابْنَةً ، فَوَلَدَتِ ابْنَتُهَا لِتِسْعِ سِنِينَ ، فَصَارَتْ هِيَ جَدَّةً ، وَهِيَ بِنْتُ ثَمَانِ عَشْرَةَ سَنَةً " .
‘Ubadah bin ‘Abbad al-Muhallabi reports: In our Muhallab tribe, there is a woman who became a grandmother at the age of eighteen. She gave birth to a daughter at the age of nine, and her daughter also gave birth to her own daughter at the age of nine. Thus, that woman became a grandmother at the age of eighteen.
Hadith 3882
نَا نَا أَبُو بَكْرٍ الشَّافِعِيُّ ، نَا مُحَمَّدُ بْنُ شَاذَانَ ، نَا مُعَلَّى بْنُ مَنْصُورٍ ، نَا ابْنُ إِدْرِيسَ ، عَنِ الشَّيْبَانِيِّ ، عَنْ بَحْرِيَّةَ بِنْتِ هَانِئِ بْنِ قَبِيصَةَ ، قَالَتْ : " زَوَّجْتُ نَفْسِي الْقَعْقَاعَ بْنَ شَوْرٍ ، وَبَاتَ عِنْدِي لَيْلَةً ، وَجَاءَ أَبِي مِنَ الأَعْرَابِ فَاسْتَعْدَى عَلِيًّا ، وَجَاءَتْ رُسُلُهُ فَانْطَلَقُوا بِهِ إِلَيْهِ ، فَقَالَ : أَدْخَلَتْ بِهَا ؟ ، قَالَ : نَعَمْ ، فَأَجَازَ النِّكَاحَ " .
Bahriyah bint Hani bin Qabisah narrates: I married Qa‘qa‘ bin Sur. He stayed with me for one night, then my father, who was a villager, presented the case before Sayyiduna Ali (may Allah be pleased with him). The messenger of Sayyiduna Ali (may Allah be pleased with him) came and took him to Sayyiduna Ali (may Allah be pleased with him). Sayyiduna Ali (may Allah be pleased with him) inquired: "Have you had intercourse with this woman?" He replied: "Yes." Sayyiduna Ali (may Allah be pleased with him) upheld the marriage.
Hadith 3883
نَا نَا أَبُو بَكْرٍ الشَّافِعِيُّ ، نَا مُحَمَّدُ بْنُ شَاذَانَ ، نَا مُعَلَّى بْنُ مَنْصُورٍ ، نَا أَبُو عَوَانَةَ ، عَنِ الشَّيْبَانِيِّ ، عَنْ بَحْرِيَّةَ بِنْتِ هَانِئٍ الأَعْوَرِ أَنَّهُ سَمِعَهَا ، تَقُولُ : " زَوَّجَهَا أَبُوهَا رَجُلا وَهُوَ نَصْرَانِيُّ ، وَزَوَّجَتْ نَفْسَهَا الْقَعْقَاعَ بْنَ شَوْرٍ ، فَجَاءَ أَبُوهَا إِلَى عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ ، فَأَرْسَلَ إِلَيْهَا وَوَجَدَ الْقَعْقَاعَ قَدْ بَاتَ عِنْدَهَا ، وَقَدِ اغْتَسَلَ فَجِئَ بِهِ إِلَى عَلِيٍّ ، وَإِنَّ عَلَيْهِ خَلُوقًا ، فَقَالَ أَبُوهَا : " فَضَحَتْنِي وَاللَّهِ مَا أَرَدْتُ هَذَا ، قَالَ : أَتَرَى بِنَائِي يَكُونُ سِرًّا ، فَارْتَفَعُوا إِلَى عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ ، فَقَالَ : دَخَلْتَ بِهَا ؟ ، قَالَ : نَعَمْ ، فَأَجَازَ نِكَاحَهَا " ، بَحْرِيَّةُ مَجْهُولَةٌ.
Bahriyah bint Hani bin Qabisah narrates: Her father married her to a man who was a Christian. This woman herself married Qa‘qa‘ bin Sur. The girl's father came to Sayyiduna Ali (may Allah be pleased with him). Sayyiduna Ali (may Allah be pleased with him) called Qa‘qa‘, and at that time he had already had intercourse with the woman and performed ghusl. He was brought before Sayyiduna Ali (may Allah be pleased with him), and there was a yellow mark on him. The girl's father said: "You have disgraced me; I did not want this." Qa‘qa‘ replied: "Do you think I married in secret?" They presented their case before Sayyiduna Ali (may Allah be pleased with him), so Sayyiduna Ali (may Allah be pleased with him) asked: "Have you had intercourse with this woman?" He replied: "Yes." So Sayyiduna Ali (may Allah be pleased with him) considered it valid for the woman to marry herself. The woman named Bahriyah is unknown.
Hadith 3884
نَا نَا أَبُو بَكْرٍ الشَّافِعِيُّ ، نَا مُحَمَّدُ بْنُ شَاذَانَ ، نَا مُعَلَّى ، نَا ابْنُ لَهِيعَةَ ، عَنْ عُبَيْدِ اللَّهِ بْنِ أَبِي جَعْفَرٍ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، قَالَ : " إِذَا كَانَ وَلِيُّ الْمَرْأَةِ مُضَارًّا فَوَلَّتْ رَجُلا فَأَنْكَحَهَا ، فَنِكَاحُهُ جَائِرٌ " .
Sayyiduna Ibn Umar (may Allah be pleased with them both) said: "When a woman's guardian is harmful and the woman appoints another person as her guardian, and he conducts her marriage, then the marriage conducted by him will be valid."
Hadith 3885
نَا نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا حَمَّادُ بْنُ الْحَسَنِ ، نَا أَبُو دَاوُدَ ، نَا شُعْبَةُ ، عَنِ الشَّيْبَانِيِّ ، قَالَ : " كَانَ فِينَا امْرَأَةٌ ، يُقَالُ لَهَا : بَحْرِيَّةُ زَوَّجَتْهَا أُمُّهَا وَأَبُوهَا غَائِبٌ ، فَلَمَّا قَدِمَ أَبُوهَا أَنْكَرَ ذَلِكَ ، فَرُفِعَ ذَلِكَ إِلَى عَلِيِّ بْنِ أَبِي طَالِبٍ ، " فَأَجَازَ النِّكَاحَ " ،.
Shaibani narrates: There was a woman in our (neighborhood or tribe) whose name was Bahriyah. Her mother married her off while her father was not present at that time. When her father came, he refused this relationship. She presented this matter before Sayyiduna Ali (may Allah be pleased with him), so Sayyiduna Ali (may Allah be pleased with him) upheld this marriage.
Hadith 3886
قَالَ : وَنا شُعْبَةُ ، عَنِ الشَّيْبَانِيِّ ، عَنْ أَبِي قَيْسٍ ، أَنَّ عَلِيًّا قَضَى فِيهَا بِذَلِكَ .
Abu Qais reports: Sayyiduna Ali (may Allah be pleased with him) gave a verdict regarding this matter.
Hadith 3887
قَالَ : وَنا شُعْبَةُ ، أنا سُفْيَانُ الثَّوْرِيُّ ، وَحَجَّاجُ بْنُ أَرْطَأَةَ ، سَمِعَا أَبَا قَيْسٍ ، يُحَدِّثُ عَنِ الْهُزَيْلِ ، أَنَّ عَلِيًّا رَضِيَ اللَّهُ عَنْهُ قَضَى بِذَلِكَ.
Hazil narrates: Sayyiduna Ali (may Allah be pleased with him) gave a verdict according to this.
