Hadith 3867
نَا نَا أَبُو بَكْرٍ الشَّافِعِيُّ ، نَا مُحَمَّدُ بْنُ شَاذَانَ ، نَا مُعَلَّى ، نَا أَبُو بَكْرِ بْنُ عَيَّاشٍ ، نَا مُغِيرَةُ ، حَدَّثَنِي قُثَمُ مَوْلَى عَبَّاسٍ ، قَالَ : " تَزَوَّجَ عَبْدُ اللَّهِ بْنُ جَعْفَرٍ ابْنَةَ عَلِيٍّ ، وَامْرَأَةَ عَلِيٍّ النَّهْشَلِيَّةَ " .
Sayyiduna Abdullah bin Ja'far (may Allah be pleased with him) married a daughter of Sayyiduna Ali (may Allah be pleased with him) and also married a wife of Sayyiduna Ali (may Allah be pleased with him), who belonged to the Nahshal tribe (i.e., he married a girl and her stepmother).
Hadith 3868
نَا أَبُو بَكْرٍ ، نَا مُحَمَّدٌ ، نَا مُعَلَّى ، نَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ أَيُّوبَ ، عَنْ مُحَمَّدٍ ، " أَنَّ رَجُلا مِنْ أَهْلِ مِصْرَ كَانَتْ لَهُ صُحْبَةٌ ، يُقَالُ لَهُ : جَبَلَةُ جَمَعَ بَيْنَ امْرَأَةِ رَجُلٍ ، وَابْنَةٍ مِنْ غَيْرِهَا " ، قَالَ أَيُّوبُ : وَكَانَ الْحَسَنُ يَكْرَهُهُ.
Narrated by a narrator named Muhammad: A companion from Egypt, whose name was Habla, married the daughter of a man’s wife and the daughter of that man’s other wife. A narrator named Ayyub reports: Hasan al-Basri considered this to be disliked.
Hadith 3869
نَا نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ إِبْرَاهِيمَ ، نَا إِسْحَاقُ بْنُ الْحَسَنِ ، نَا أَبُو حُذَيْفَةَ ، نَا سُفْيَانُ ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ ، عَنْ طَاوُسٍ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : " الْخُلْعُ فُرْقَةٌ ، وَلَيْسَ بِطَلاقٍ " .
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrated: "Khul‘ is separation; it is not divorce."
Hadith 3870
نَا نَا أَبُو بَكْرٍ الشَّافِعِيُّ ، نَا مُحَمَّدُ بْنُ شَاذَانَ ، نَا مُعَلَّى بْنُ مَنْصُورٍ ، نَا أَبُو عَوَانَةَ ، عَنْ لَيْثٍ ، عَنْ طَاوُسٍ ، عَنِ ابْنِ عَبَّاسٍ ، " أَنَّهُ جَمَعَ بَيْنَ رَجُلٍ وَامْرَأَتِهِ بَعْدَ تَطْلِيقَتَيْنِ وَخُلْعٍ " .
It is narrated about Sayyiduna Ibn Abbas (may Allah be pleased with them) that he reunited a husband and wife who had previously undergone two divorces and a khul‘.
Hadith 3871
نَا يَحْيَى بْنُ صَاعِدٍ ، نَا بُنْدَارٌ ، نَا مُحَمَّدُ بْنُ جَعْفَرٍ غُنْدَرٌ ، نَا ابْنُ جُرَيْجٍ ، عَنْ عَطَاءٍ ، قَالَ : جَاءَتِ امْرَأَةٌ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " تَشْكُو زَوْجَهَا ، فَقَالَ : رُدِّي عَلَيْهِ حَدِيقَتَهُ ، قَالَتْ : نَعَمْ وَزِيَادَةً ، قَالَ : أَمَّا الزِّيَادَةُ فَلا " ، خَالَفَهُ الْوَلِيدُ ، عَنِ ابْنِ جُرَيْجٍ ، أَسْنَدَهُ عَنْ عَطَاءٍ ، عَنِ ابْنِ عَبَّاسِ . وَالْمُرْسَلُ أَصَحُّ.
Ata reports: A woman came to the service of the Prophet (peace be upon him) and complained about her husband. The Prophet (peace be upon him) said: "Return his garden to him (which he gave you as dowry, and obtain khul‘)." The woman said: "Alright, I will give him even more along with it." The Prophet (peace be upon him) said: "There is no need for any additional (payment)." Waleed narrated with a different chain from Ibn Jurayj, who narrated from Ata, from Sayyiduna Ibn Abbas (may Allah be pleased with them both), however, its being mursal is correct.
Hadith 3872
نَا نَا ابْنُ صَاعِدٍ ، نَا أَبُو عُبَيْدِ اللَّهِ الْمَخْزُومِيُّ ، نَا سُفْيَانُ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ جُمْهَانَ مَوْلَى الأَسْلَمِيِّ ، عَنْ أُمِّ بَكْرَةَ الأَسْلَمِيَّةِ ، " أَنَّهَا اخْتَلَعَتْ مِنْ زَوْجِهَا فِي زَمَانِ عُثْمَانَ بْنِ عَفَّانَ ، فَقَالَ عُثْمَانُ هِيَ تَطْلِيقَةٌ ، إِلا أَنْ يَكُونَا سَمَّيَا شَيْئًا فَهُوَ عَلَى مَا سَمَّيَاهُ " .
Jumhan narrates: During the caliphate of Sayyiduna Uthman Ghani (may Allah be pleased with him), Sayyidah Umm Bakrah Aslamah (may Allah be pleased with her) obtained khul‘ from her husband, so Sayyiduna Uthman (may Allah be pleased with him) said: "This will be counted as one divorce, however, if both of them have agreed upon something else, then it will be according to what they have agreed upon."
Hadith 3873
ثنا ثنا أَحْمَدُ بْنُ الْعَبَّاسِ الْبَغَوِيُّ ، نَا أَحْمَدُ بْنُ مَنْصُورٍ ، نَا حَبَّانُ بْنُ هِلالٍ ، نَا هَمَّامٌ ، عَنْ مَطَرٍ ، عَنْ ثَابِتٍ ، عَنْ عَبْدِ اللَّهِ بْنِ رَبَاحٍ ، أَنَّ عُمَرَ ، قَالَ " فِي الْمُخْتَلِعَةِ : يَخْتَلِعُ بِمَا دُونَ عِقَاصِ رَأْسِهَا " .
Sayyiduna Umar (may Allah be pleased with him) said: "A woman seeking khul‘ can obtain khul‘ in exchange for something of lesser value than her bird."
