Hadith 3855
نَا مُحَمَّدُ بْنُ الْقَاسِمِ بْنِ زَكَرِيَّا الْمُحَارِبِيُّ ، نَا هِشَامُ بْنُ يُونُسَ ، نَا عَبْدُ الرَّحْمَنِ الْمُحَارِبِيُّ ، عَنْ إِسْمَاعِيلَ بْنِ مُسْلِمٍ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، عَنْ طَاوُسٍ ، عَنِ ابْنِ عَبَّاسٍ ، " أَنَّ رَجُلا ظَاهَرَ مِنِ امْرَأَتِهِ ، فَرَأَى بَيَاضَ الْخَلْخَالِ فِي السَّاقِ فِي الْقَمَرِ ، فَوَقَعَ عَلَيْهَا ، فَأَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرَهُ ، فَقَالَ : أَمَا سَمِعْتَ اللَّهَ يَقُولُ : مِنْ قَبْلِ أَنْ يَتَمَاسَّا سورة المجادلة آية 3 ، أَمْسِكْ عَلَيْكَ امْرَأَتَكَ حَتَّى تُكَفِّرَ " .
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: A man did zihar with his wife. Then, on a moonlit night, he saw the shine of that woman’s shin, so (he could not control himself) and had intercourse with her. Then he came to the service of the Prophet (peace and blessings be upon him) and informed him, so the Prophet (peace and blessings be upon him) said: “Have you not heard the statement of Allah: Before the two of them have intercourse with each other (expiation must be given)?” (The Prophet, peace and blessings be upon him, said) “Now, until you give the expiation, do not have intercourse with your wife.”
Hadith 3856
نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا مُحَمَّدُ بْنُ يَحْيَى ، نَا يَزِيدُ بْنُ هَارُونَ ، أنا مُحَمَّدُ بْنُ إِسْحَاقَ ، عَنْ مُحَمَّدِ بْنِ عَمْرِو بْنِ عَطَاءٍ ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ ، عَنْ سَلَمَةَ بْنِ صَخْرٍ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَمَرَهُ ، أَنْ يَأْتِيَ بَنِي فُلانٍ فَيَأْخُذَ مِنْهُمْ وَسْقًا مِنْ تَمْرٍ ، فَيُعْطِيَهُ سِتِّينَ مِسْكِينًا " .
Sayyiduna Salamah bin Sakhr (may Allah be pleased with him) narrates: The Prophet (peace and blessings of Allah be upon him) instructed him: "Go to the people of such-and-such tribe and collect one wasq of dates from them, and give that (one wasq) to sixty needy people."
Hadith 3857
نَا نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا مُحَمَّدُ بْنُ يَحْيَى ، وَالْمَيْمُونِيُّ ، قَالا : نَا عَبْدُ اللَّهِ بْنُ بَكْرٍ ، نَا سَعِيدٌ ، عَنْ قَتَادَةَ ، وَمَطَرٍ ، عَنْ رَجَاءِ بْنِ حَيْوَةَ ، عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ ، عَنْ عَمْرِو بْنِ الْعَاصِ " فِي الْمُظَاهِرِ إِذَا وَطِئَ قَبْلَ أَنْ يُكَفِّرَ عَلَيْهِ كَفَّارَتَانِ " ، .
Regarding the person who performs zihar, Sayyiduna ‘Amr ibn al-‘As (may Allah be pleased with him) says: “If he has intercourse before offering the expiation, then two expiations will be obligatory upon him.”
Hadith 3858
نَا أَبُو بَكْرٍ ، نَا مُحَمَّدُ بْنُ يَحْيَى ، نَا عَبْدُ الرَّزَّاقِ ، أنا مَعْمَرٌ ، عَنْ قَتَادَةَ ، قَالَ قَبِيصَةُ بْنُ ذُؤَيْبٍ : " عَلَيْهِ كَفَّارَتَانِ ".
Qabeesah bin Dhuwaiyb said: "Such a person will be required to pay two expiations."
Hadith 3859
نَا أَبُو بَكْرٍ الشَّافِعِيُّ ، نَا مُحَمَّدُ بْنُ شَاذَانَ ، نَا مُعَلَّى ، نَا يَحْيَى بْنُ حَمْزَةَ ، عَنْ إِسْحَاقَ بْنِ أَبِي فَرْوَةَ ، عَنْ بُكَيْرِ بْنِ الأَشَجِّ ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ ، عَنْ سَلَمَةَ بْنِ صَخْرٍ ، " أَنَّهُ ظَاهَرَ فِي زَمَانِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، ثُمَّ وَقَعَ بِامْرَأَتِهِ ، قَبْلَ أَنْ يُكَفِّرَ ، فَأَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَذَكَرَ ذَلِكَ لَهُ ، فَأَمَرَهُ أَنْ يُكَفِّرَ تَكْفِيرًا وَاحِدًا " .
Sayyiduna Salamah bin Sakhr (may Allah be pleased with him) narrates: During the blessed time of the Prophet (peace and blessings be upon him), he performed zihar with his wife, and before offering the expiation, he had intercourse with that woman. He presented himself before the Prophet (peace and blessings be upon him) and mentioned this matter. The Prophet (peace and blessings be upon him) instructed him: "He should offer only one expiation."
Hadith 3860
حَدَّثَنَا أَحْمَدُ بْنُ إِسْحَاقَ بْنِ الْبُهْلُولِ ، نَا أَبُو سَعِيدٍ الأَشَجُّ ، نَا عَبْدُ اللَّهِ بْنُ إِدْرِيسَ ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ ، عَنْ مُحَمَّدِ بْنِ عَمْرِو بْنِ عَطَاءٍ ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ ، عَنْ سَلَمَةَ بْنِ صَخْرٍ الْبَيَاضِيِّ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " فِي الْمُظَاهِرِ يُوَاقِعُ قَبْلَ أَنْ يُكَفِّرَ ، قَالَ : كَفَّارَةٌ وَاحِدَةٌ " .
Sayyiduna Salamah bin Sakhr (may Allah be pleased with him) narrates regarding a person who performs zihar and then has intercourse (with his wife) before offering the expiation, that the Prophet (peace and blessings of Allah be upon him) said: "His expiation will be only one."
Hadith 3861
نَا نَا يُوسُفُ بْنُ يَعْقُوبَ بْنِ إِسْحَاقَ بْنِ بُهْلُولٍ ، حَدَّثَنِي جَدِّي ، حَدَّثَنِي أَبِي ، نَا أَبُو جُرَيٍّ ، عَنْ أَيُّوبَ السَّخْتِيَانِيِّ ، عَنِ ابْنِ أَبِي مُلَيْكَةَ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : " مَنْ شَاءَ بَاهَلْتُهُ أَنَّهُ لَيْسَ لِلأَمَةِ ظِهَارٌ " .
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: "Whoever wishes, I am ready to engage in Mubahala with him on this issue that Zihar does not apply to a slave woman."
Hadith 3862
نَا نَا أَبُو بَكْرٍ الشَّافِعِيُّ ، نَا مُحَمَّدُ بْنُ شَاذَانَ ، نَا مُعَلَّى بْنُ مَنْصُورٍ ، نَا ابْنُ لَهِيعَةَ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، قَالَ : " لا ظِهَارَ مِنَ الأَمَةِ " .
Amr bin Shu'aib narrates from his father, from his grandfather: "Zihar does not apply to a slave woman."
Hadith 3863
وَنا وَنا ابْنُ لَهِيعَةَ ، عَنْ عَطَاءٍ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : " لَيْسَ فِي الأَمَةِ ظِهَارٌ " .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: "Zihar does not apply to a slave woman."
Hadith 3864
نَا نَا أَبُو بَكْرٍ ، نَا مُحَمَّدُ بْنُ شَاذَانَ ، نَا مُعَلَّى ، نَا عَبْدُ الْوَارِثِ ، نَا عَلِيُّ بْنُ الْحَكَمِ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، عَنْ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ ، سُئِلَ " عَنْ رَجُلٍ ظَاهَرَ مِنْ أَرْبَعِ نِسْوَةٍ ، قَالَ : كَفَّارَةٌ وَاحِدَةٌ " .
It was asked from Sayyiduna Umar bin Khattab (may Allah be pleased with him) about a person who performs zihar with his four wives, so he said: "There will be only one expiation for him."
Hadith 3865
نَا نَا أَبُو بَكْرٍ ، نَا مُحَمَّدُ بْنُ شَاذَانَ ، نَا مُعَلَّى ، نَا أَبُو عَوَانَةَ ، عَنْ جَابِرٍ ، عَنْ مُجَاهِدٍ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : كَانَ عُمَرُ بْنُ الْخَطَّابِ ، يَقُولُ : " إِذَا كَانَ تَحْتَ الرَّجُلِ أَرْبَعُ نِسْوَةٍ فَظَاهَرَ مِنْهُنَّ ، تُجْزِيهِ كَفَّارَةٌ وَاحِدَةٌ " .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates the statement of Sayyiduna Umar bin Khattab (may Allah be pleased with him): "When a man has four wives and he pronounces zihar to all of them, then he will have to pay only one expiation."
Hadith 3866
نَا عُمَرُ بْنُ أَحْمَدَ بْنِ عَلِيٍّ الْجَوْهَرِيُّ ، نَا سَعِيدُ بْنُ مَسْعُودٍ ، نَا النَّضْرُ بْنُ شُمَيْلٍ ، نَا شُعْبَةُ ، عَنْ سُلَيْمَانَ يَعْنِي الشَّيْبَانِيَّ ، وَالْمُغِيرَةِ ، وَحُصَيْنٌ ، قَالُوا : سَمِعْنَا الشَّعْبِيَّ ، قَالَ : قَالَتْ عَائِشَةُ بِنْتُ طَلْحَةَ : إِنْ تَزَوَّجْتُ مُصْعَبَ بْنَ الزُّبَيْرِ فَهُوَ عَلَيَّ كَظَهْرِ أَبِي ، فَسَأَلَتْ عَنْ ذَلِكَ ، فَأُمِرَتْ أَنْ تُعْتِقَ رَقَبَةً وَتَتَزَوَّجَهُ " .
Aisha bint Talha narrates: I said, "If I marry Mus'ab bin Zubair, he would be for me like the back of my father (i.e., forbidden to me)." Then she inquired about its ruling, and she was instructed to free a slave. After that, she married Mus'ab bin Zubair.
