الْمُحْرِمُ لَا يَنْكِحُ
The Muhrim (pilgrim in Ihram) does not marry
Hadith 2640
نا أَبُو عَلِيٍّ مُحَمَّدُ بْنُ سُلَيْمَانَ الْمَالِكِيُّ ، نا بُنْدَارٌ ، نا يَحْيَى بْنُ سَعِيدٍ الْقَطَّانُ ، نا مَالِكٌ . ح وَنا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نا الرَّبِيعُ بْنُ سُلَيْمَانَ ، أنا الشَّافِعِيُّ ، أنا مَالِكٌ ، عَنْ نَافِعٍ ، عَنْ نُبَيْهِ بْنِ وَهْبٍ ، عَنْ أَبَانَ بْنِ عُثْمَانَ ، عَنْ عُثْمَانَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " الْمُحْرِمُ لا يَنْكِحُ وَلا يُنْكِحُ " ، زَادَ الشَّافِعِيُّ : " وَلا يَخْطُبُ ".
Sayyiduna Uthman Ghani (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings be upon him): "A person in the state of ihram can neither marry himself nor arrange the marriage of another." Imam Shafi'i has transmitted these additional words: "And he cannot even propose marriage to anyone."
Hadith 2641
نا الْقَاضِي الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نا أَحْمَدُ بْنُ إِسْمَاعِيلَ الْمَدَنِيُّ ، نا مَالِكٌ ، عَنْ نَافِعٍ ، عَنْ نُبَيْهِ بْنِ وَهْبٍ أَخِي بَنِي عَبْدِ الدَّارِ أَخْبَرَ ، أَنَّ عُمَرَ بْنَ عُبَيْدِ اللَّهِ أَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ ، وَأَبَانُ يَوْمَئِذٍ أَمِيرُ الْحَاجِّ وَهُمَا مُحْرِمَانِ ، إِنِّي أُرِيدُ أَنْ أُنْكِحَ طَلْحَةَ بْنَ عُمَرَ ابْنَةَ شَيْبَةَ بْنِ جُبَيْرٍ ، وَأَرَدْتُ أَنْ تَحْضُرَ ذَلِكَ ، فَأَنْكَرَ ذَلِكَ عَلَيْهِ أَبَانُ بْنُ عُثْمَانَ ، وَقَالَ : سَمِعْتُ عُثْمَانَ بْنَ عَفَّانَ ، يَقُولُ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْمُحْرِمُ لا يَنْكِحُ ، وَلا يَخْطُبُ ، وَلا يُنْكِحُ " .
Nabiyah bin Wahb narrates: Umar bin Ubaidullah sent a message to Aban bin Uthman, who was the Amir of Hajj at that time. Both of them were in the state of Ihram. (The message was:) I want to marry Talhah bin Umar to the daughter of Shaybah bin Jubair, and I wish for you to participate in this as well. But Aban rejected his request and said: I heard Sayyiduna Uthman Ghani (may Allah be pleased with him) narrate that the Noble Prophet (peace and blessings be upon him) said: "A person in the state of Ihram cannot marry himself, nor can he send a marriage proposal to someone, nor can he arrange the marriage of anyone else."
