Hadith 2141
حَدَّثَنَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، ثنا يُوسُفُ بْنُ مُوسَى ، ثنا سُفْيَانُ بْنُ عُيَيْنَةَ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، سَمِعَ بَجَالَةَ ، يَقُولُ : كُنْتُ كَاتِبًا لِجَزْءِ بْنِ مُعَاوِيَةَ عَمِّ الأَحْنَفِ بْنِ قَيْسٍ فَأَتَانَا كِتَابُ عُمَرَ بْنِ الْخَطَّابِ قَبْلَ مَوْتِهِ بِسَنَةٍ : اقْتُلْ كُلَّ سَاحِرٍ ، وَفَرِّقُوا بَيْنَ كُلِّ ذِي مُحْرِمٍ مِنَ الْمَجُوسِ ، وَانْهَوْهُمْ عَنِ الزَّمْزَمَةِ . فَقَتَلْنَا ثَلاثَ سَوَاحِرَ ، وَجَعَلْنَا نُفَرِّقُ بَيْنَ الرَّجُلِ وَبَيْنَ حَرِيمِهِ فِي كِتَابِ اللَّهِ ، وَصَنَعَ طَعَامًا كَثِيرًا ، وَدَعَا الْمَجُوسَ وَعَرَضَ السَّيْفَ عَلَى فَخِذِهِ ، فَأَلْقَوْا وَقْرَ بَغْلٍ أَوْ بَغْلَيْنِ مِنْ وَرِقٍ ، يَعْنِي مِنْ فِضَّةٍ ، وَأَكَلُوا بِغَيْرِ زَمْزَمَةٍ ، وَلَمْ يَكُنْ عُمَرُ أَخَذَ الْجِزْيَةَ مِنَ الْمَجُوسِ حَتَّى شَهِدَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَخَذَهَا مِنْ مَجُوسِ أَهْلِ هَجَرَ " .
Mujalid narrates: I was the secretary of Juza’ bin Mu’awiyah, who is the uncle of Sayyiduna Ahnaf bin Qais. A letter from Sayyiduna Umar (may Allah be pleased with him) came to us; this was one year before his death. (It was written in it): "Kill every sorcerer, and among the Magians, whoever has married a woman who is his close relative, separate them, and prohibit them from Zamzamah." (The narrator says) We had three sorcerers killed, and we separated every man from such a wife with whom marriage has been forbidden by Allah Almighty. Then he had a lot of food prepared and invited the Magians. He placed his sword upon his knees, and those people placed there an amount of silver equal to the weight of a mule or two mules, and they ate food without Zamzamah. The narrator states: Sayyiduna Umar (may Allah be pleased with him) did not take jizyah from the Magians until Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) testified that the Noble Prophet (peace and blessings be upon him) had taken jizyah from the Magians of Hajar.
Hadith 2142
حَدَّثَنَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، ثنا يُوسُفُ بْنُ مُوسَى ، ثنا أَبُو مُعَاوِيَةَ ، ثنا الْحَجَّاجُ بْنُ أَرْطَاةَ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، عَنْ بَجَالَةَ بْنِ عَبْدَةَ ، كَذَا قَالَ أَبُو مُعَاوِيَةَ ، قَالَ : كُنْتُ كَاتِبًا لِجَزْءِ بْنِ مُعَاوِيَةَ عَلَى الْمَنَاذِرِ ، فَقَدِمَ عَلَيْنَا كِتَابُ عُمَرَ بْنِ الْخَطَّابِ ، أَنَّ عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ أَخْبَرَنِي ، " أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَخَذَ مِنَ الْمَجُوسِ أَهْلِ هَجَرَ الْجِزْيَةَ " . فَخُذْ مِنْ مَجُوسِ مَنْ قِبَلَكَ الْجِزْيَةَ . حَجَّاجٌ لا يُحْتَجُّ بِهِ.
Abu Muawiyah narrates: I was the secretary of Sayyiduna Juz’ bin Muawiyah. We received a letter from Sayyiduna Umar bin Khattab (may Allah be pleased with him) (in which it was written): "Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) has informed me that the Prophet Muhammad (peace and blessings be upon him) took jizya from the Magians of Hajar, so you should also take jizya from the Magians of your region." The narrator of this narration, Hajjaj, is not reliable.
Hadith 2143
حَدَّثَنَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، وَآخَرُونَ ، قَالُوا : نا مُحَمَّدُ بْنُ مُسْلِمِ بْنِ وَارَهٍ ، نا الْخَضِرُ بْنُ مُحَمَّدِ بْنِ شُجَاعٍ ، أنا هُشَيْمٌ ، نا دَاوُدُ بْنُ أَبِي هِنْدَ ، عَنْ قُشَيْرِ بْنِ عَمْرٍو ، عَنْ بَجَالَةَ ، قَالَ : " لَمْ يَأْخُذْ عُمَرُ الْجِزْيَةَ مِنَ الْمَجُوسِ ، حَتَّى شَهِدَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَخَذَ مِنْهُمْ " . قَالَ : وَقَالَ ابْنُ عَبَّاسٍ : كُنْتُ جَالِسًا بِبَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَدَخَلَ عَلَيْهِ رَجُلانِ مِنْهُمْ ، ثُمَّ خَرَجَا ، فَقُلْتُ : مَاذَا قَضَى رَسُولُ اللَّهِ ؟ فَقَالا : " الإِسْلامُ أَوِ الْقَتْلُ " ، قَالَ ابْنُ عَبَّاسٍ : فَأَخَذَ النَّاسُ بِقَوْلِ عَبْدِ الرَّحْمَنِ ، وَتَرَكُوا قُولِي.
The narrator named Bajalah reports: Sayyiduna Umar (may Allah be pleased with him) did not initially take jizya from the Magians, until Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) testified that the Noble Prophet (peace and blessings be upon him) had taken jizya from these Magians. The narrator states: Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) has stated: Once I was sitting at the door of the Noble Prophet (peace and blessings be upon him), two men came to him, then both of them came out, so I inquired: What decision did the Noble Prophet (peace and blessings be upon him) make regarding both of them? So both of them informed (he gave this decision): "Either we accept Islam or we will be killed." Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) states: So the people accepted the statement of Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) and abandoned my narration.
Hadith 2144
حَدَّثَنَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ ، ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، ثنا عَبْدُ الرَّزَّاقِ ، أنا مَعْمَرٌ ، وَابْنُ عُيَيْنَةَ ، وَابْنُ جُرَيْجٍ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، قَالَ : سَمِعْتُ بَجَالَةَ التَّمِيمِيَّ ، قَالَ : " وَلَمْ يَكُنْ عُمَرُ يُرِيدُ أَنْ يَأْخُذَ الْجِزْيَةَ مِنَ الْمَجُوسِ ، حَتَّى شَهِدَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَخَذَهَا مِنْ مَجُوسِ هَجَرَ " .
Bajalah al-Tamimi narrates: Sayyiduna Umar (may Allah be pleased with him) did not want to take jizya from the Magians, until Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) testified that the Noble Prophet (peace and blessings be upon him) had taken jizya from the Magians of "Hajr."
Hadith 2145
حَدَّثَنَا حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ بْنِ مُبَشِّرٍ ، نا أَحْمَدُ بْنُ سِنَانٍ ، وَالْحَسَنُ بْنُ صَالِحٍ الْبَزَّازُ ، سَمِعْتُ أَبَا عَاصِمٍ ، عَنْ سُفْيَانَ ، عَنْ مَنْصُورٍ ، عَنْ أَبِي رَزِينٍ ، عَنْ أَبِي مُوسَى ، عَنْ حُذَيْفَةَ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : " لَوْلا أَنِّي رَأَيْتُ أَصْحَابِي أَخَذُوا الْجِزْيَةَ مِنَ الْمَجُوسِ مَا أَخَذْتُهَا مِنْهُمْ ، وَتَلا : قَاتِلُوا الَّذِينَ لا يُؤْمِنُونَ بِاللَّهِ وَلا بِالْيَوْمِ الآخِرِ وَلا يُحَرِّمُونَ مَا حَرَّمَ اللَّهُ وَرَسُولُهُ سورة التوبة آية 29 ، إِلَى آخِرِ الآيَةِ حَتَّى يُعْطُوا الْجِزْيَةَ عَنْ يَدٍ وَهُمْ صَاغِرُونَ سورة التوبة آية 29 " .
Sayyiduna Hudhayfah (may Allah be pleased with him) narrates: If I had not seen my companions collecting jizyah from the Magians, I would not have collected it from them. Then he recited this verse: "And fight those who do not believe in Allah and the Last Day, and do not consider unlawful what Allah and His Messenger have made unlawful." This verse continues to the end: "Until they pay the jizyah with willing submission, and feel themselves subdued."
