Hadith 1943
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ، ثنا دَاوُدُ بْنُ رُشَيْدٍ ، ثنا الْوَلِيدُ ، عَنِ ابْنِ لَهِيعَةَ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنِ السَّائِبِ بْنِ يَزِيدَ ، قَالَ : صَحِبْتُ سَعْدَ بْنَ أَبِي وَقَّاصٍ فَذَكَرَ كَلامًا ، فَقَالَ : أَلا إِنِّي سَمِعْتُهُ ذَاتَ يَوْمٍ ، يَقُولُ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ وَلا يُجْمَعُ بَيْنَ مُفَرَّقٍ ، وَالْخَلِيطَانِ مَا اجْتَمَعَ عَلَى الْحَوْضِ وَالرَّاعِي وَالْفَحْلِ " .
Sa’ib bin Yazid narrates: I have accompanied Sayyiduna Sa’d bin Abi Waqqas (may Allah be pleased with him), after which he mentioned something, then he also stated: One day he heard Sayyiduna Sa’d bin Abi Waqqas (may Allah be pleased with him) saying: The Noble Prophet (peace and blessings be upon him) said: “(For the purpose of collecting zakat or to avoid zakat) joint wealth should not be separated, nor should separate wealth be combined, and two partners are those who share a watering place, a shepherd, and (an animal given for mating purposes).”
Hadith 1944
حَدَّثَنَا الْحَسَنُ بْنُ أَحْمَدَ بْنِ صَالِحٍ الْكُوفِيُّ ، ثنا عَبْدُ اللَّهِ بْنُ إِسْحَاقَ بْنِ أَبِي مُسْلِمٍ ، ثنا مُحَمَّدُ بْنُ أَبِي مُوسَى ، ثنا حَجَّاجٌ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ زِيَادِ بْنِ سَعْدٍ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لَيْسَ فِي الْمُثِيرَةِ صَدَقَةٌ " .
Sayyiduna Jabir (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: "There is no zakat due on the musheerah (i.e., the cow that is used for plowing)."
Hadith 1945
حَدَّثَنَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، ثنا أَبُو الأَزْهَرِ ، ثنا عَبْدُ الرَّزَّاقِ ، ثنا ابْنُ جُرَيْجٍ ، قَالَ : سَأَلْتُ عَطَاءً عَنِ النَّفْرِ الْخُلَطَاءِ لَهُمْ أَرْبَعُونَ شَاةً ، قَالَ : " عَلَيْهِمْ شَاةٌ " ، فَإِنْ كَانَتْ لِوَاحِدٍ تِسْعَةٌ وَثَلاثُونَ وَلِلآخَرِ شَاةٌ ، قَالَ : " عَلَيْهِمَا شَاةٌ " .
Ibn Jurayj narrates: I asked Ata about those people who are partners with each other and have forty goats, so is the payment of one goat obligatory on all of them? I asked: If one of them has 39 goats and the other has one goat? He replied the same: "The payment of one goat will be obligatory on both of them."
Hadith 1946
حَدَّثَنَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، ثنا عَبْدُ اللَّهِ بْنُ أَيُّوبَ ، حَدَّثَنَا رَوْحٌ ، ثنا حَمَّادُ بْنُ سَلَمَةَ ، عَنْ حُمَيْدِ بْنِ هِلالٍ ، قَالَ : جَاءَ رَجُلٌ إِلَى الْحَسَنِ بِصَحِيفَةٍ فِيهَا مَسَائِلُ يَسْأَلُهُ عَنْهَا ، فَمَا تَتَعْتَعَ فِي شَيْءٍ مِنْهَا حَتَّى أَتَى عَلَى أَرْبَعِينَ شَاةً بَيْنَ نَفَسَيْنِ ، فَقَالَ : " فِيهَا شَاةٌ عَلَيْهِمَا " .
Humaid bin Hilal narrates: A person came to Hasan al-Basri with a scroll in which various issues were written. He asked him about this scroll, and Hasan did not find any mistake in those issues. However, when the issue came that forty goats are jointly owned by two people, he said: "Both of them are required to pay one goat."
Hadith 1947
حَدَّثَنَا أَبُو عُثْمَانَ سَعِيدُ بْنُ مُحَمَّدِ بْنِ أَحْمَدَ الْحَنَّاطُ ، ثنا إِسْحَاقُ بْنُ أَبِي إِسْرَائِيلَ ، ثنا عَبَّادُ بْنُ الْعَوَّامِ ، ثنا هِلالُ بْنُ خَبَّابٍ ، عَنْ مَيْسَرَةَ بْنِ أَبِي صَالِحٍ ، عَنْ سُوَيْدِ بْنِ غَفَلَةَ ، قَالَ : أَتَانَا مُصَدِّقُ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَجَلَسْتُ إِلَى جَنْبِهِ ، قَالَ : فَسَمِعْتُهُ يَقُولُ : " إِنَّ فِي عَهْدِي أَنْ لا آخُذَ مِنْ رَاضِعِ لَبَنٍ شَيْئًا ، قَالَ : وَلا يُجْمَعُ بَيْنَ مُفْتَرِقٍ وَلا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ " . وَأَتَاهُ رَجُلٌ بِنَاقَةٍ كَوْمَاءَ ، فَقَالَ : خُذْ هَذِهِ ، فَأَبَى أَنْ يَأْخُذَهَا.
Sayyiduna Suwaid bin Ghaflah (may Allah be pleased with him) narrates: A person who collected zakat on behalf of the Prophet (peace and blessings of Allah be upon him) came to us. I sat beside him. The narrator says: I heard him saying that I have been instructed: "I should not take any animal that is giving milk, and (while collecting zakat) separate property should not be combined, nor should combined property be separated." The narrator says: A man brought a she-camel with a high hump to him and said, "You may take this." He refused to accept it.
Hadith 1948
حَدَّثَنَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، ثنا أَبُو حُمَيْدٍ الْجَلابُ أَحْمَدُ بْنُ إِدْرِيسَ ، ثنا هُشَيْمٌ ، عَنْ هِلالِ بْنِ خَبَّابٍ ، عَنْ أَبِي صَالِحٍ مَيْسَرَةَ ، عَنْ سُوَيْدِ بْنِ غَفَلَةَ ، قَالَ : أَتَانَا مُصَدِّقُ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَعَدْتُ إِلَيْهِ ، فَقُلْتُ : إِيشْ فِي كِتَابِكَ ؟ فَقَالَ : " أَنْ لا أُفَرِّقَ بَيْنَ مُجْتَمِعٍ وَلا أَجْمَعَ بَيْنَ مُفَرَّقٍ " . فَأَتَاهُ رَجُلٌ بِنَاقَةٍ كَوْمَاءَ ، فَأَبَى أَنْ يَقْبَلَهَا.
Sayyiduna Suwaid bin Ghaflah (may Allah be pleased with him) narrates: A person who collected zakat on behalf of the Prophet (peace and blessings be upon him) came to us. I sat with him and asked him, "What is written in your document?" He replied, "I will not combine separate property nor separate combined property." The narrator says: Then a man brought to him a she-camel with a high hump, but he refused to accept it.
Hadith 1949
حَدَّثَنَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، وَالْحُسَيْنُ بْنُ يَحْيَى بْنِ عَيَّاشٍ ، قَالا : نا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ يَحْيَى بْنِ سَعِيدٍ ، ثنا يَحْيَى بْنُ آدَمَ ، ثنا شَرِيكٌ ، عَنْ عُثْمَانَ بْنِ أَبِي زُرْعَةَ ، عَنْ أَبِي لَيْلَى سِنَانٍ ، عَنْ سُوَيْدِ بْنِ غَفَلَةَ ، قَالَ : قَدِمَ عَلَيْنَا مُصَدِّقُ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : فَقَرَأْتُ فِي كِتَابِهِ : " لا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ وَلا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ " ، قَالَ : فَأَتَاهُ رَجُلٌ بِنَاقَةٍ عَظِيمَةٍ حَسْنَاءَ مُلَمْلَمَةٍ ، فَأَبَى أَنْ يَأْخُذَهَا ، وَقَالَ : مَا عُذْرِي عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذَا أَخَذْتُ هَذِهِ مِنْ مَالِ رَجُلٍ مُسْلِمٍ ؟ قَالَ يَحْيَى : ثُمَّ سَمِعْتُ شَرِيكًا بَعْدُ يَذْكُرُ هَذَا الْحَدِيثَ ، عَنْ عِمْرَانَ بْنِ مُسْلِمٍ ، عَنْ سُوَيْدِ بْنِ غَفَلَةَ ، فَذَكَرْتُهُ لِوَكِيعٍ ، فَقَالَ : إِنَّمَا سَمِعْنَاهُ مِنْهُ عَنْ عُثْمَانَ.
Sayyiduna Suwaid bin Ghaflah (may Allah be pleased with him) narrates: A person who was a collector of zakat on behalf of the Prophet Muhammad (peace be upon him) came to us. The narrator says: I read in his written instructions that: "Separate wealth should not be combined, nor should combined wealth be separated, in order to avoid (paying or collecting) zakat." The narrator says: Then after that, a man came to him with a large she-camel, which was very beautiful and healthy, but he refused to accept the she-camel. He said: "If I take this from a Muslim's wealth, then what will I do in the presence of the Prophet Muhammad (peace be upon him)?" This narration is also transmitted with another chain, however, there is some difference in it.
