نَا ابْنُ مَنِيعٍ ، نَا دَاوُدُ بْنُ رُشَيْدٍ ، نَا مَرْوَانُ بْنُ مُعَاوِيَةَ ، نَا دَهْثَمُ بْنُ قُرَّانٍ ، نَا عَقِيلُ بْنُ دِينَارٍ مَوْلَى حَارِثَةَ بْنِ ظُفُرٍ ، عَنْ حَارِثَةَ بْنِ ظُفُرٍ ، " أَنَّ دَارًا كَانَتْ بَيْنَ أَخَوَيْنِ فَحَظَرَا فِي وَسَطَهَا حِظَارًا ، ثُمَّ هَلَكَا وَتَرَكَ كُلُّ وَاحِدٍ مِنْهُمَا عَقِبًا ، فَادَّعَى كُلُّ وَاحِدٍ مِنْهُمَا أَنَّ الْحِظَارَ لَهُ مِنْ دُونِ صَاحِبِهِ ، فَاخْتَصَمَ عَقَبَاهُمَا إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَرْسَلَ حُذَيْفَةَ بْنَ الْيَمَانِ فَقَضَى بَيْنَهُمَا فَقَضَى بِالْحِظَارِ لِمَنْ وَجَدَ مَعَاقِدَ الْقِمْطِ تَلِيهِ ، ثُمَّ رَجَعَ فَأَخْبَرَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَصَبْتَ ، قَالَ دَهْثَمٌ ، أَوْ قَالَ : أَحْسَنْتَ " ، خَالَفَهُ فِي الإِسْنَادِ أَبُو بَكْرِ بْنُ عَيَّاشٍ.
Haritha bin Zufar reports that a house was jointly owned by two brothers. They erected a fence between them. Then both of them passed away, leaving behind children as heirs. Each of the children claimed that the land with the fence was in their share and not in the other’s. When people brought this case to the Prophet Muhammad (peace be upon him), he sent Hudhayfah bin al-Yaman (may Allah be pleased with him) to judge between them. He measured the wall to see which land it was adjacent to, and gave the verdict in favor of the relevant person. He returned and informed the Prophet (peace be upon him) about it, and the Prophet (peace be upon him) said: “You have judged correctly.”
