حَدَّثَنَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، وَمُحَمَّدُ بْنُ مَخْلَدٍ ، وَآخَرُونَ ، قَالُوا : نَا عَلِيُّ بْنُ حَرْبٍ ، نَا عَبْدُ اللَّهِ بْنُ إِدْرِيسَ ، عَنِ ابْنِ جُرَيْجٍ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، قَالَ : " قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الشُّفْعَةِ فِي كُلِّ شِرْكٍ لَمْ يُقْسَمْ : رَبْعَةٌ ، أَوْ حَائِطٌ لا يَحِلُّ لَهُ أَنْ يَبِيعَهُ حَتَّى يَسْتَأْذِنَ شَرِيكَهُ " ، وَقَالَ ابْنُ مَخْلَدٍ : حَتَّى يُؤْذِنَ شَرِيكَهُ ، فَإِنْ شَاءَ أَخَذَ ، وَإِنْ شَاءَ تَرَكَ ، فَإِنْ بَاعَهُ ، وَلَمْ يُؤْذِنْهُ ، فَهُوَ أَحَقُّ بِهِ " ، لَمْ يَقُلْ : يُقْسَمُ فِي هَذَا الْحَدِيثِ إِلا ابْنُ إِدْرِيسَ ، وَهُوَ مِنَ الثِّقَاتِ الْحُفَّاظِ.
Sayyiduna Jabir (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) gave this ruling: "There is pre-emption (shuf‘a) in every such thing which is jointly owned by two people and cannot be divided, such as land or a garden. It is not permissible for a man to sell it until he seeks permission from his partner." In another narration, it is stated that as long as his partner does not permit him, if the partner wishes, he may take it, and if he wishes, he may leave it. If a person sells such a property and does not inform his partner, then the partner has a greater right to that property. In this narration, the words "can be divided" have only been narrated by the narrator named Abdullah bin Idris, and he is trustworthy and a memorizer (hafiz).
