نَا عَلِيُّ بْنُ عَبْدِ اللَّهِ بْنِ مُبَشِّرٍ ، نَا أَحْمَدُ بْنُ سِنَانٍ ، نَا عَمْرُو بْنُ عَوْنٍ ، أنا أَبُو الأَحْوَصِ ، عَنْ أَبِي صَالِحٍ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : " وُجِدَ رَجُلٌ مِنَ الأَنْصَارِ قَتِيلا فِي دَالِيَةِ نَاسٍ مِنَ الْيَهُودِ فَذَكَرُوا ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، " فَبَعَثَ إِلَيْهِمْ فَأَخَذَ مِنْهُمْ خَمْسِينَ رَجُلا مِنْ خِيَارِهِمْ فَاسْتَحْلَفَ كُلَّ وَاحِدٍ مِنْهُمْ بِاللَّهِ مَا قَتَلْتُ وَلا عَلِمْتُ قَاتِلا ، ثُمَّ جَعَلَ الدِّيَةَ عَلَيْهِمْ ، قَالُوا : لَقَدْ قَضَى بِمَا فِي نَامُوسِ مُوسَى الْكَلْبِيُّ " مَتْرُوكٌ.
Abdullah bin Abbas (may Allah be pleased with them both) narrates: An Ansari was found murdered near a well of the Jews in Khaybar. The people mentioned this matter to the Prophet Muhammad (peace be upon him). The Prophet (peace be upon him) sent a message to those people that they should bring fifty men, and each one of them should swear by name, saying: "I did not kill him, nor do I know anything about the killer." Then the Prophet (peace be upon him) made the payment of blood money obligatory upon them. So they said: This gentleman has given the same verdict as was in the law of Musa (Moses), peace be upon him.
