نَا ابْنُ صَاعِدٍ ، نَا مُحَمَّدُ بْنُ عُمَرَ بْنِ هَيَّاجٍ ، نَا يَحْيَى بْنُ عَبْدِ الرَّحْمَنِ الأَرْحَبِيُّ ، حَدَّثَنِي عُبَيْدَةُ بْنُ الأَسْوَدِ ، ثنا الْقَاسِمُ بْنُ الْوَلِيدِ ، عَنْ سِنَانِ بْنِ الْحَارِثِ بْنِ مُصَرِّفٍ ، عَنْ طَلْحَةَ بْنِ مُصَرِّفٍ ، عَنْ مُجَاهِدٍ ، عَنِ ابْنِ عُمَرَ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " الْمُدَّعَى عَلَيْهِ أَوْلَى بِالْيَمِينِ ، إِلا أَنْ تَقُومَ بَيِّنَةٌ " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) stated that the person against whom a claim is made has the right to take only an oath; however, if evidence is presented (then the ruling will be different).
