نَا مُحَمَّدُ بْنُ يَحْيَى بْنِ مِرْدَاسٍ ، نَا أَبُو دَاوُدَ ، نَا عَبَّادُ بْنُ مُوسَى ، نَا إِسْمَاعِيلُ بْنُ جَعْفَرٍ ، نَا إِسْرَائِيلُ ، عَنْ عُثْمَانَ الشَّحَّامِ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ بِهَذَا وَقَالَ : " فَلَمَّا كَانَ الْبَارِحَةَ جَعَلَتْ تَشْتُمُكَ ، وَتَقَعُ فِيكَ فَقَتَلْتُهَا ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَلا اشْهَدُوا أَنَّ دَمَهَا هَدَرٌ " ، قَالَ الشَّيْخُ الدَّارَقُطْنِيُّ : فِيهِ سُنَّةٌ فِي الأَصْلِ فِي إِشْهَادِ الْحَاكِمِ عَلَى نَفْسِهِ بِإِنْفَاذِ الْقَضَاءِ.
The same narration is reported from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both), however, in it are these words: That man said: The other day, this woman began to speak ill of you and showed disrespect towards you, so I killed her. The Noble Prophet (peace and blessings be upon him) said: "Bear witness, all of you, that the blood of this woman is wasted." Imam Daraqutni has stated that from this, the Sunnah is established that while passing a judgment, a ruler may make people witnesses regarding his own self.
