نَا جَعْفَرُ بْنُ مُحَمَّدِ بْنِ أَحْمَدَ الْوَاسِطِيُّ ، نَا مُوسَى بْنُ هَارُونَ ، نَا أَبُو بَكْرٍ الأَثْرَمُ ، نَا عَبْدُ الرَّحْمَنِ بْنُ دُبَيْسٍ الْكِنْدِيُّ ، نَا صَالِحُ بْنُ عُمَرَ ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ ، أَصَابَ أَرْضًا بِخَيْبَرَ ، فَأَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " إِنِّي أَصَبْتُ أَرْضًا بِخَيْبَرَ مَا أَصَبْتُ مَالا هُوَ أَنْفَسُ عِنْدِي مِنْهُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا ، وَتَصَدَّقْتَ بِهَا ، فَقَالَ : فَحَبَسَ عُمَرُ أَصْلَهَا وَتَصَدَّقَ بِهَا ، لا تُبَاعُ ، وَلا تُوهَبُ ، وَلا تُورَثُ ، فِي الْفُقَرَاءِ ، وَذَوِي الْقُرْبَى ، وَالرِّقَابِ ، وَالضَّيْفِ ، وَفِي سَبِيلِ اللَّهِ ، وَابْنِ السَّبِيلِ ، وَلا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ بِالْمَعْرُوفِ وَيُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ مِنْهُ مَالا " ، قَالَ الأَثْرَمُ : أَفَادَنا ابْنُ نُمَيْرٍ هَذَا الشَّيْخَ.
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that Sayyiduna Umar bin Khattab (may Allah be pleased with him) acquired a piece of land in Khaybar. He presented himself before the Noble Prophet (peace and blessings be upon him) and said: "I have acquired a piece of land in Khaybar, and I have never received any land that is more valuable to me than this one." The Noble Prophet (peace and blessings be upon him) said: "If you wish, keep the original land with you and give its produce as charity." The narrator states: So Sayyiduna Umar (may Allah be pleased with him) kept the original land with himself and gave its produce as charity, in such a way that the land could neither be sold, nor gifted, nor inherited. Its produce would be distributed among the poor, close relatives, guests, warriors in the path of Allah, and travelers. Whoever is its caretaker will not be sinful if he eats from it in a reasonable manner or feeds a friend from it, as long as he is not accumulating wealth from it.
