قُرِئَ عَلَى أَبِي مُحَمَّدِ بْنُ يَحْيَى بْنِ صَاعِدٍ ، قِيلَ لَهُ : وَفِي كِتَابِكَ عَنْ حَبِيبِ بْنِ بِشْرٍ الأَزْدِيِّ ، نَا سَعِيدُ بْنُ سُفْيَانَ الْجَحْدَرِيُّ ، نَا صَخْرُ بْنُ جُوَيْرِيَةَ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : يَا رَسُولَ اللَّهِ ، " إِنِّي اسْتَفَدْتُ مَالا وَهُوَ نَفِيسٌ فَأَرَدْتُ أَنْ أَتَصَدَّقَ بِهِ ، قَالَ : تَصَدَّقْ بِأَصْلِهَا لا يُبَاعُ ، وَلا يُوهَبُ ، وَلا يُورَثُ ، وَلَكِنْ يُنْفَقُ ثَمَرَتُهُ ، قَالَ : فَتَصَدَّقَ بِهِ ، فَصَدَقْتُهُ كُتِبَتْ عَلَى ذَلِكَ فِي سَبِيلِ اللَّهِ وَالضَّيْفِ ، وَابْنِ السَّبِيلِ ، وَالْمَسَاكِينِ ، وَذِي الْقُرْبَى ، لا جُنَاحَ عَلَى مَنْ وَلِيَهُ أَنْ يَأْكُلَ بِالْمَعْرُوفِ وَيُطْعِمَ صَدِيقَهُ غَيْرَ مَأْثُومٍ فِيهِ " .
Abdullah bin Umar (may Allah be pleased with them both) narrates that Umar bin Khattab (may Allah be pleased with him) said: "O Messenger of Allah! I have acquired a piece of land which is the best I have ever obtained, and I wish to give it in charity." So the Prophet (peace and blessings of Allah be upon him) said: "Give it as charity in such a way that the original land cannot be sold, nor given as a gift, nor inherited, and its produce should be spent (in the way of Allah)." The narrator says: So Umar (may Allah be pleased with him) gave it as charity in this manner, and he had it written in the document of charity that it may be given in the way of Allah (i.e., to the warriors in Allah’s cause), to guests, travelers, the poor, and close relatives. Whoever is the caretaker of this land, if he eats from it in a reasonable manner or feeds a friend from it, there is no harm and no sin upon him.
