نَا أَبُو سَهْلٍ أَحْمَدُ بْنُ مُحَمَّدِ بْنِ زِيَادٍ ، وَجَعْفَرُ بْنُ مُحَمَّدِ بْنِ أَحْمَدَ الْوَاسِطِيُّ ، قَالا : نَا مُوسَى بْنُ هَارُونَ ، نَا مُحَمَّدُ بْنُ خَلَفٍ الْعَسْقَلانِيُّ ، بِعَسْقَلانَ ، نَا رَوَّادُ بْنُ الْجَرَّاحِ ، عَنْ صَدَقَةَ بْنِ يَزِيدَ ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : يَا رَسُولَ اللَّهِ ، " مَا مِنْ مَالِي شَيْءٌ أَحَبُّ إِلَيَّ مِنَ الْمِائَةِ وَسْقٍ الَّتِي أَطْعَمْتَنِيهَا مِنْ خَيْبَرَ ، فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " فَاحْبِسْ أَصْلَهَا وَاجْعَلْ ثَمَرَهَا صَدَقَةً ، قَالَ : فَكَتَبَ عُمَرُ هَذَا الْكِتَابَ : مِنْ عُمَرَ بْنِ الْخَطَّابِ فِي ثَمْغٍ وَالْمِائَةِ الْوَسْقِ الَّتِي أَطْعَمَنِيهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ أَرْضِ خَيْبَرَ ، إِنِّي حَبَسْتُ أَصْلَهَا وَجَعَلْتُ ثَمَرَتَهَا صَدَقَةً لِذِي الْقُرْبَى ، وَالْيَتَامَى ، وَالْمَسَاكِينِ ، وَابْنِ السَّبِيلِ وَالْمُقِيمِ عَلَيْهَا أَنْ يَأْكُلَ أَوْ يُطْعِمَ صَدِيقًا لا جُنَاحَ ، وَلا يُبَاعُ ، وَلا يُوهَبُ ، وَلا يُورَثُ ، مَا قَامَتِ السَّمَاوَاتُ وَالأَرْضُ ، جَعَلَ ذَلِكَ إِلَى ابْنَتِهِ حَفْصَةَ ، فَإِذَا مَاتَتْ ، فَإِلَى ذِي الرَّأْيِ مِنْ أَهْلِهَا " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that Sayyiduna Umar bin Khattab (may Allah be pleased with him) submitted: "O Messenger of Allah! To me, the best wealth is that land whose yield is one hundred wasq, which you granted me in Khaybar." So the Noble Prophet (peace and blessings be upon him) said to him: "Keep the original land with you and give its produce in charity." The narrator says: So Sayyiduna Umar (may Allah be pleased with him) had this written: "This is from Umar bin Khattab, regarding the land of 'Shamgh' and about those one hundred wasq which the Noble Prophet (peace and blessings be upon him) granted me, which are in Khaybar. I will keep its original with me and give its produce in charity, which will go to close relatives, orphans, the needy, travelers, and the one who supervises it. The supervisor may eat from it himself and may feed a friend from it; there will be no sin upon him. However, this land cannot be sold, nor gifted, nor inherited, as long as the heavens and the earth remain." Sayyiduna Umar (may Allah be pleased with him) made this bequest to his daughter, Sayyidah Hafsa (may Allah be pleased with her), and then if she passed away, this bequest would transfer to another person of sound judgment from the family of Sayyidah Hafsa (may Allah be pleased with her).
