نَا عَلِيُّ بْنُ مُحَمَّدِ بْنِ أَحْمَدَ الْمِصْرِيُّ ، نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ سَعِيدِ بْنِ أَبِي مَرْيَمَ ، نَا مُحَمَّدُ بْنُ يُوسُفَ الْفِرْيَابِيُّ ، نَا سُفْيَانُ الثَّوْرِيُّ ، عَنِ ابْنِ عَوْنٍ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، عَنْ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : أَصَبْتُ أَرْضًا مِنْ أَرْضِ خَيْبَرَ مَا أَصَبْتُ مَالا قَطُّ أَنْفَسَ عِنْدِي مِنْهُ ، فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَسْتَأْمِرُهُ ، فَقُلْتُ : يَا رَسُولَ اللَّهِ ، " إِنِّي أَصَبْتُ مَالا مِنْ خَيْبَرَ مَا أَصَبْتُ مَالا أَنْفَسَ عِنْدِي مِنْهُ ، فَقَالَ : إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا ، وَتَصَدَّقْتَ بِهَا ، فَتَصَدَّقَ بِهَا عُمَرُ عَلَى أَنْ لا يُبَاعَ ، وَلا يُوهَبَ ، وَلا يُوَرَّثَ ، فَتَصَدَّقَ بِهَا عُمَرُ فِي الْفُقَرَاءِ ، وَفِي الأَقْرَبِينَ ، وَفِي سَبِيلِ اللَّهِ ، وَفِي الرِّقَابِ ، وَابْنِ السَّبِيلِ ، وَالضَّيْفِ ، لا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ وَيُعْطِيَ بِالْمَعْرُوفِ صَدِيقًا غَيْرَ مُتَمَوِّلٍ " ، قَالَ ابْنُ عَوْنٍ : فَذَكَرْتُهُ لابْنِ سِيرِينَ ، قَالَ : غَيْرَ مُتَأَثِّلٍ مَالا . تَابَعَهُ أَبُو إِسْحَاقَ الْفَزَارِيُّ ، عَنِ ابْنِ عَوْنٍ .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates the statement of Sayyiduna Umar bin Khattab (may Allah be pleased with him): I acquired a piece of land in Khaybar, which was the best property I ever had. I went to the Prophet (peace and blessings be upon him) to seek your opinion about it. I said, "O Messenger of Allah! I have acquired a piece of land in Khaybar, which is the best I have ever had." The Prophet (peace and blessings be upon him) said: "If you wish, keep the original land and give its produce as charity." So Sayyiduna Umar (may Allah be pleased with him) gave it as charity in such a way that it could neither be sold, nor gifted, nor inherited. Sayyiduna Umar (may Allah be pleased with him) gave its produce as charity to the poor, close relatives, warriors in Allah’s cause, slaves, travelers, and guests. And there is no sin upon the person who manages it if he eats from it in a reasonable manner or gives some to a friend in a reasonable manner, as long as he is not accumulating wealth from it. There is a difference among the narrators regarding one word of this narration.
