نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ أَحْمَدَ بْنِ سَعْدَانَ ، بِوَاسِطَ ، نَا شُعَيْبُ بْنُ أَيُّوبَ . ح وَنا أَبُو صَالِحٍ الأَصْبَهَانِيُّ ، نَا أَبُو مَسْعُودٍ ، قَالا : نَا أَبُو دَاوُدَ الْحَفَرِيُّ ، نَا سُفْيَانُ ، عَنِ ابْنِ عَوْنٍ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، عَنْ عُمَرَ بْنِ الْخَطَّابِ ، قَالَ : " أَصَبْتُ أَرْضًا مِنْ أَرْضِ خَيْبَرَ ، فَقُلْتُ : يَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، " أَصَبْتُ أَرْضًا لَمْ أُصِبْ مَالا أَحَبَّ إِلَيَّ مِنْهُ ، وَلا أَنْفَسَ عِنْدِي مِنْهُ ، قَالَ : إِنْ شِئْتَ تَصَدَّقْتَ بِهَا وَأَمْسَكْتَ أَصْلَهَا ، قَالَ : فَتَصَدَّقَ بِهَا عُمَرُ عَلَى أَنْ لا يُبَاعَ ، وَلا يُوهَبَ ، فِي الْفُقَرَاءِ ، وَالْقُرْبَى ، وَالضَّيْفِ ، وَالرِّقَابِ ، وَابْنِ السَّبِيلِ ، لا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ بِالْمَعْرُوفِ غَيْرَ مُتَمَوِّلٍ مَالا " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that Sayyiduna Umar bin Khattab (may Allah be pleased with him) stated that he acquired a piece of land in Khaybar. He said: "O Messenger of Allah! I have obtained a piece of land which is more beloved to me than any other land I have ever acquired, and there is no land more precious than this." The Prophet (peace and blessings be upon him) said: "If you wish, give it as charity in such a way that the original land remains with you." The narrator says: So Sayyiduna Umar (may Allah be pleased with him) gave that land as charity in such a way that it could neither be sold nor gifted, and its produce would be for the poor, close relatives, slaves, guests, and travelers. Whoever is its caretaker will not be sinful if he eats from it in a reasonable manner, as long as he is not accumulating wealth from it.
