قُرِئَ عَلَى مُحَمَّدِ بْنِ الْحَسَنِ بْنِ أَبِي الشَّوَارِبِ ، قِيلَ لَهُ : سَمِعْتَ الْعَبَّاسَ بْنَ يَزِيدَ ، نَا مُعَاذُ بْنُ مُعَاذٍ وَ الأَنْصَارِي ُّ ، قَالا : نَا ابْنُ عَوْنٍ ، ح وَنا أَبُو صَالِحٍ عَبْدُ الرَّحْمَنِ بْنُ سَعِيدِ بْنِ هَارُونَ الأَصْبَهَانِيُّ ، نَا أَبُو مَسْعُودٍ أَحْمَدُ بْنُ الْفُرَاتِ ، أنا يَزِيدُ بْنُ هَارُونَ ، أنا ابْنُ عَوْنٍ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنَّ عُمَرَ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : أَصَبْتُ أَرْضًا بِخَيْبَرَ ، فَقُلْتُ : يَا رَسُولَ اللَّهِ ، " إِنِّي أَصَبْتُ أَرْضًا مَا أَصَبْتُ مَالا قَطُّ هُوَ أَنْفَسُ عِنْدِي مِنْهُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : إِنْ شِئْتَ تَصَدَّقْتَ بِهَا وَحَبَسْتَ أَصْلَهَا ، قَالَ : فَجَعَلَهَا عُمَرُ لا تُبَاعُ وَلا تُوهَبُ وَلا تُورَثُ ، وَتَصَدَّقَ بِهَا عَلَى الْفُقَرَاءِ وَالْمَسَاكِينِ ، وَابْنِ السَّبِيلِ ، وَالْغُزَاةِ فِي سَبِيلِ اللَّهِ ، وَفِي الرِّقَابِ ، وَالضَّيْفِ ، لا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا وَيُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ فِيهِ ، وَأَوْصَى بِهَا إِلَى حَفْصَةَ رَضِيَ اللَّهُ عَنْهَا ، ثُمَّ إِلَى الأَكَابِرِ مِنْ آلِ عُمَرَ رَضِيَ اللَّهُ عَنْهُ " ، هَذَا لَفْظُ أَبِي مَسْعُودٍ ، قَالَ أَبُو مَسْعُودٍ : هَذَا أَجْوَدُ حَدِيثٍ رَوَاهُ ابْنُ عَوْنٍ ، زَادَ مُعَاذٌ وَأَوْصَى بِهَا إِلَى حَفْصَةَ أُمِّ الْمُؤْمِنِينَ ، ثُمَّ إِلَى الأَكَابِرِ مِنْ آلِ عُمَرَ . قَالَ ابْنُ عَوْنٍ : فَحَدَّثْتُ بِهِ ابْنَ سِيرِينَ ، فَقَالَ : غَيْرَ مُتَأَثِّلٍ مَالا ،.
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that Sayyiduna Umar (may Allah be pleased with him) stated that he acquired a piece of land in Khaybar, so he said: "O Messenger of Allah! I have obtained a land such that I have never acquired a better land than this." The Prophet (peace and blessings be upon him) said: "If you wish, give it as charity and keep the original land with you." The narrator says: So Sayyiduna Umar (may Allah be pleased with him) did it in such a way that it could neither be sold, nor gifted, nor inherited, and its produce was given as charity to the poor, the needy, travelers, warriors, slaves, and guests. The person who was its caretaker would not be sinful if he ate from it himself or fed a friend from it, as long as he was not accumulating wealth. Sayyiduna Umar (may Allah be pleased with him) made this bequest to Sayyida Hafsa (may Allah be pleased with her), and after her, to the elderly members of Sayyiduna Umar’s family. These are the words of the narrator named Abu Mas’ud, though other narrators have reported it with some differences in wording.
