نَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا أَحْمَدُ بْنُ مَنْصُورٍ زَاجٌ ، نَا النَّضْرُ بْنُ شُمَيْلٍ ، نَا عَبْدُ اللَّهِ بْنُ عَوْنٍ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ ، " أَصَابَ أَرْضًا بِخَيْبَرَ ، فَأَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَسْتَأْمِرُهُ فِيهَا ، فَقَالَ : يَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، " إِنِّي أَصَبْتُ أَرْضًا بِخَيْبَرَ مَا أَصَبْتُ مَالا قَطُّ أَنْفَسَ عِنْدِي مِنْهُ فَمَا تَأْمُرُنِي بِهَا ؟ ، قَالَ : إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا ، قَالَ : فَتَصَدَّقَ بِهَا أَنَّهَا لا تُبَاعُ أَصْلُهَا ، وَلا تُوهَبُ ، وَلا تُورَثُ ، فَتَصَدَّقَ بِهَا عَلَى الْفُقَرَاءِ ، وَالْقُرْبَى وَفِي الرِّقَابِ ، وَفِي سَبِيلِ اللَّهِ ، وَابْنِ السَّبِيلِ ، وَالضَّيْفِ ، لا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ بِالْمَعْرُوفِ ، أَوْ يُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ مِنْهَا " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that Sayyiduna Umar bin Khattab (may Allah be pleased with him) acquired a piece of land in Khaybar. He came to the Prophet (peace and blessings be upon him) to consult him about it, and said: "O Messenger of Allah! I have obtained a piece of land in Khaybar, and I have never acquired land better than this. What do you command me regarding it?" The Prophet (peace and blessings be upon him) said: "If you wish, keep the land and give its produce as charity." The narrator says: So Sayyiduna Umar (may Allah be pleased with him) gave it as charity in such a way that the original land could neither be sold, nor gifted, nor inherited, and its produce was to be given as charity to the poor, close relatives, slaves, warriors in the cause of Allah, travelers, and guests. And there was no sin upon the person who managed it if he ate from it in a reasonable manner or fed a friend from it, as long as he was not accumulating wealth.
