نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ زِيَادٍ ، نَا عَبْدُ الرَّحْمَنِ بْنُ مَرْزُوقٍ ، نَا عَبْدُ الْوَهَّابِ ، أنا سَعِيدٌ ، عَنْ قَتَادَةَ ، عَنْ شَهْرِ بْنِ حَوْشَبٍ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ غَنْمٍ ، عَنْ عَمْرِو بْنِ خَارِجَةَ ، قَالَ : " خَطَبَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِمِنًى ، فَقَالَ : إِنَّ اللَّهَ عَزَّ وَجَلَّ قَدْ قَسَمَ لِكُلِّ إِنْسَانٍ نَصِيبَهُ مِنَ الْمِيرَاثِ ، فَلا تَجُوزُ لِوَارِثٍ وَصِيَّةٌ إِلا مِنَ الثُّلُثِ " ، .
Sayyiduna Amr bin Kharijah (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) addressed us in Mina and said: “Allah Almighty has fixed the share of inheritance for every person among you, therefore it is not permissible to make a bequest in favor of an heir. However, a bequest can be made from one third of the wealth.”
