حَدَّثَنَا أَبُو مُحَمَّدِ بْنُ صَاعِدٍ ، نَا مُحَمَّدُ بْنُ زِيَادِ بْنِ الرَّبِيعِ الزِّيَادِيُّ ، نَا مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ الطُّفَاوِيُّ ، عَنْ صَخْرِ بْنِ جُوَيْرِيَةَ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ قَالَ " فِي الْعَبْدِ وَالأَمَةِ : إِذَا كَانَا بَيْنَ شُرَكَاءَ فَأَعْتَقَ أَحَدُهُمْ نَصِيبَهُ مِنْهُ ، فَإِنَّهُ يَجِبُ عَلَى الَّذِي أَعْتَقَهُ عِتْقُ نَصِيبَهُ مِنْهُ ، إِذَا كَانَ لَهُ مِنَ الْمَالِ مَا يَبْلُغُ ثَمَنَهُ دَفَعَ بَقِيَّةَ ثَمَنِهِ إِلَى شُرَكَائِهِ ، وَيُخَلَّى سَبِيلُ الْمُعْتَقِ " ، قَالَ ابْنُ صَاعِدٍ : هَذَا فِي هَذَا الْحَدِيثِ ، وَالأَمَةُ.
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates this statement of the Noble Prophet (peace and blessings be upon him) regarding a slave or slave-girl who is jointly owned by some people, and one of them frees his share. Then it is obligatory upon the one who freed his share to free the remaining shares as well. If that person possesses wealth equal to the value of the slave, he should pay the remaining amount of the price to the other partners, and the slave will be considered free on behalf of that person. One narrator has also mentioned the slave-girl in this narration.
