حَدَّثَنَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا أَحْمَدُ بْنُ سَعِيدِ بْنِ صَخْرٍ ، نَا النَّضْرُ بْنُ شُمَيْلٍ ، نَا شُعْبَةُ ، عَنْ قَتَادَةَ ، عَنِ النَّضْرِ بْنِ أَنَسٍ ، عَنْ بَشِيرِ بْنِ نَهِيكٍ ، عَنْ أَبِي هُرَيْرَةَ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ " فِي الْمَمْلُوكِ بَيْنَ الرَّجُلَيْنِ يُعْتِقُ أَحَدُهُمَا نَصِيبَهُ ، قَالَ : يَضْمَنُ " ، وَافَقَهُ هِشَامٌ الدَّسْتُوَائِيُّ فَلَمْ يَذْكُرِ الاسْتِسْعَاءَ ، وَشُعْبَةُ وَهِشَامٌ أَحْفَظُ مَنْ رَوَاهُ ، عَنْ قَتَادَةَ . وَرَوَاهُ هَمَّامٌ فَجَعَلَ الاسْتِسْعَاءَ مِنْ قَوْلِ قَتَادَةَ ، وَفَصَلَهُ مِنْ كَلامِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ . وَرَوَاهُ ابْنُ أَبِي عَرُوبَةَ ، وَجَرِيرُ بْنُ حَازِمٍ ، عَنْ قَتَادَةَ ، فَجَعَلَ الاسْتِسْعَاءَ مِنْ قَوْلِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ . وَأَحْسَبُهُمَا وَهِمَا فِيهِ لِمُخَالَفَةِ شُعْبَةَ ، وَهِشَامٍ ، وَهَمَّامٍ إِيَّاهُمَا .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "If a slave is jointly owned by two men, and one of them frees his share, then the Noble Prophet (peace and blessings be upon him) said: 'That person will be responsible (for the rest).'” The narrator named Hisham has agreed with this narration and did not mention that the slave would be made to work for wages. Shu’bah and Hisham, in narrating from Qatadah, are more reliable than other narrators. The narrator named Hammam, while narrating this tradition, mentioned that Qatadah said: "Such a slave will be made to work for wages." He mentioned this statement of Qatadah separately from the words of the Noble Prophet (peace and blessings be upon him), whereas other narrators have attributed the command of making the slave work for wages to the Noble Prophet (peace and blessings be upon him) through Qatadah. I believe that those narrators are mistaken in this matter, because this narration is different from the narration transmitted by Shu’bah and Hisham.
