Hadith 4218

نَا أَبُو عَبْدِ اللَّهِ مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا مُحَمَّدُ بْنُ هَارُونَ أَبُو نَشِيطٍ ، نَا أَبُو الْمُغِيرَةِ ، نَا عَبْدُ الرَّحْمَنِ بْنُ يَزِيدَ بْنِ تَمِيمٍ ، نَا الزُّهْرِيُّ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ كَانَ لَهُ شَرِيكٌ فِي عَبْدٍ أَوْ أَمَةٍ فَأَعْتَقَ نَصِيبَهُ ، فَإِنَّ عَلَيْهِ عِتْقَ مَا بَقِيَ فِي الْعَبْدِ وَالأَمَةِ مِنْ حِصَصِ شُرَكَائِهِ ، يُقَامُ قِيمَةُ عَدْلٍ ، وَيُودِي إِلَى شُرَكَائِهِ قِيمَةَ حِصَصِهِمْ ، وَيَعْتِقُ الْعَبْدَ وَالأَمَةَ إِنْ كَانَ فِي مَالِ الْمُعْتَقِ بِقِيمَةِ حِصَصِ شُرَكَائِهِ " .
Abdullah bin Umar (may Allah be pleased with them both) narrates that the Noble Prophet (peace and blessings be upon him) said: "If a person owns a share in a slave or a slave-girl and he frees his share, then it becomes obligatory upon him to free the remaining shares of that slave or slave-girl from the other owners as well. The value will be assessed justly, and he will pay his partners according to the value of their shares. He will free that slave or slave-girl, but this is only when the person freeing has enough wealth to pay the value of his partners' shares."
