نَا عَلِيُّ بْنُ عَبْدِ اللَّهِ بْنِ مُبَشِّرٍ ، نَا أَحْمَدُ بْنُ سِنَانٍ ، نَا يَزِيدُ بْنُ هَارُونَ ، أنا الْحَسَنُ بْنُ عُمَارَةَ ، عَنْ عَبْدِ الْمَلِكِ ، عَنْ طَاوُسٍ ، عَنِ ابْنِ عَبَّاسٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " فِيمَا أَحْرَزَ الْعَدُوُّ فَاسْتَنْقَذَهُ الْمُسْلِمُونَ مِنْهُمْ ، أَوْ أَخَذَهُ صَاحِبُهُ قَبْلَ أَنْ يُقْسَمَ فَهُوَ أَحَقُّ ، فَإِنْ وَجَدَهُ وَقَدْ قُسِمَ فَإِنْ شَاءَ أَخَذَهُ بِالثَّمَنِ " ، الْحَسَنُ بْنُ عُمَارَةَ مَتْرُوكٌ.
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates this statement of the Noble Prophet (peace and blessings be upon him): "The wealth which the enemy takes possession of, and then the Muslims acquire that wealth from them, before it is distributed, its original owner can take it; he has more right to it. But if he finds it after it has been distributed, then if he wishes, he can obtain it in exchange for its price." One of the narrators of this narration, Hasan bin ‘Ammarah, is abandoned.
