نَا نَا مُحَمَّدُ بْنُ مَنْصُورِ بْنِ أَبِي أَحْمَدَ الشِّيعِيُّ ، نَا نَصْرُ بْنُ عَلِيٍّ ، نَا خَالِدُ بْنُ الْحَارِثِ ، نَا سَعِيدُ بْنُ أَبِي عَرُوبَةَ ، عَنْ قَتَادَةَ ، عَنْ رَجَاءِ بْنِ حَيْوَةَ ، عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ ، عَنْ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : " مَا أَصَابَ الْمُشْرِكُونَ مِنْ أَمْوَالِ الْمُسْلِمِينَ فَظُهِرَ عَلَيْهِمْ فَرَأَى رَجُلٌ مِنَّا مَتَاعَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ مِنْ غَيْرِهِ ، فَإِذَا قُسِمَ ثُمَّ ظَهَرُوا عَلَيْهِ فَلا شَيْءَ لَهُ إِنَّمَا هُوَ رَجُلٌ مِنْهُمْ " ، وَقَالَ أَبُو سَهْلٍ : " هُوَ أَحَقُّ بِهِ مِنْ غَيْرِهِ بِالثَّمَنِ " ، هَذَا مُرْسَلٌ.
Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: "If the polytheists acquire any wealth belonging to the Muslims, and then the Muslims overpower those people, and any one of us finds his own property with them exactly as it was, then he has more right to that property than anyone else. However, if that wealth has been distributed as spoils of war and then the Muslims gain control over it, then that person will not receive anything; he will be considered an ordinary member among them." Abu Sahl has stated that in exchange for its price, he will have more right to acquire that property. This narration is "mursal."
