ح وَنا ابْنُ مَنِيعٍ ، نَا دَاوُدُ بْنُ رُشَيْدٍ ، نَا مُحَمَّدُ بْنُ سَلَمَةَ ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ ، عَنْ يَزِيدَ بْنِ عَبْدِ اللَّهِ بْنِ قُسَيْطٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، قَالَ : أَبْقَتْ أَمَةٌ لِبَعْضِ الْعَرَبِ فَوَقَعَتْ بِوَادِي الْقُرَى فَانْتَهَتْ إِلَى الْحَيِّ الَّذِي أَبْقَتْ مِنْهُمْ ، فَتَزَوَّجَهَا رَجُلٌ مِنْ بَنِي عُذْرَةَ ، فَنَثَرَتْ لَهُ ذَاتَ بَطْنِهَا ، ثُمَّ عَثَرَ عَلَيْهَا سَيِّدُهَا بَعْدُ فَاسْتَاقَهَا وَوَلَدَهَا ، فَقَضَى عُمَرُ لِلْعُذْرِيِّ بِغَرَرِ وَلَدِهِ الْغُرَّةُ لِكُلِّ وَصِيفٍ وَصِيفٌ ، وَلِكُلِّ وَصِيفَةٍ وَصِيفَةٌ ، وَجَعَلَ ثَمَنَ الْغُرَّةِ إِذْ لَمْ يُوجَدْ عَلَى أَهْلِ الْقُرَى سِتِّينَ دِينَارًا ، أَوْ سَبْعَمِائَةِ دِرْهَمٍ ، وَعَلَى أَهْلِ الْبَادِيَةِ سِتَّ فَرَائِضَ " .
Saeed bin Musayyib narrates: A slave girl belonging to an Arab ran away and reached Wadi al-Qura. She reached the tribe from whom she had fled. A man from the tribe of Banu Udhrah married her, and she bore him many children. Then the master of the slave girl reached her and wanted to take possession of the slave girl and her children. So, Sayyiduna Umar (may Allah be pleased with him) gave this verdict in the case: The man from the tribe of Udhrah should pay compensation for his children by giving a slave (or slave girl) in exchange; for a boy, a male slave, and for a girl, a female slave. If these are not available, then for a city dweller, 60 dinars or 700 dirhams should be paid in exchange for a slave, and for villagers, six faraid will be imposed.
