Hadith 4007

نَا نَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا يَعْقُوبُ الدَّوْرَقِيُّ ، نَا إِسْمَاعِيلُ بْنُ عُلَيَّةَ ، نَا هِشَامٌ الدَّسْتُوَائِيُّ ، قَالَ : كَتَبَ إِلَيَّ يَحْيَى بْنُ أَبِي كَثِيرٍ يُحَدِّثُ ، عَنْ عِكْرِمَةَ ، عَنْ عُمَرَ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : " الْحَرَامُ يَمِينٌ يُكَفِّرُهَا " .
Ikrimah narrates the statement of Sayyiduna Umar (may Allah be pleased with him): The use of the word "haram" (for the wife) is not (a divorce) but an oath, for which expiation must be given. Sayyiduna Abdullah ibn Abbas (may Allah be pleased with them both) says regarding the use of the word "haram": This is an oath for which expiation must be given. Sayyiduna Ibn Abbas (may Allah be pleased with them both) says: For you, there is the best example in the life of the Noble Prophet (peace and blessings be upon him); the Noble Prophet (peace and blessings be upon him) declared his slave-girl haram upon himself, and Allah said: "Why do you declare haram what Allah has made halal for you?" The verse continues until: "Indeed, Allah has ordained for you..." So the Noble Prophet (peace and blessings be upon him) gave expiation for his oath, and he considered the use of the word "haram" to be an oath.
