نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ زِيَادٍ الْقَطَّانُ ، نَا إِبْرَاهِيمُ بْنُ مُحَمَّدٍ ، نَا إِبْرَاهِيمُ بْنُ مُحَمَّدِ بْنِ الْهَيْثَمِ صَاحِبُ الطَّعَامِ ، نَا مُحَمَّدُ بْنُ حُمَيْدٍ ، نَا سَلَمَةُ بْنُ الْفَضْلِ ، عَنْ عَمْرِو بْنِ أَبِي قَيْسٍ ، عَنْ إِبْرَاهِيمَ بْنِ عَبْدِ الأَعْلَى ، عَنْ سُوَيْدِ بْنِ غَفَلَةَ ، قَالَ : كَانَتْ عَائِشَةُ الْخَثْعَمِيَّةُ عِنْدَ الْحَسَنِ بْنِ عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ ، فَلَمَّا أُصِيبَ عَلِيٌّ وَبُويِعَ الْحَسَنُ بِالْخِلافَةِ ، قَالَتْ : لِتَهْنِكَ الْخِلافَةَ يَا أَمِيرَ الْمُؤْمِنِينَ ، فَقَالَ : يُقْتَلُ عَلِيٌّ وَتُظْهِرِينَ الشَّمَاتَةَ ، اذْهَبِي فَأَنْتِ طَالِقٌ ثَلاثًا ، قَالَ : فَتَلَفَّعَتْ نِسَاجَهَا وَقَعَدَتْ حَتَّى انْقَضَتْ عِدَّتُهَا ، وَبَعَثَ إِلَيْهَا بِعَشَرَةِ آلافٍ مُتْعَةً وَبَقِيَّةً بَقِيَ لَهَا مِنْ صَدَاقِهَا ، فَقَالَتْ : مَتَاعٌ قَلِيلٌ مِنْ حَبِيبٍ مُفَارِقٍ ، فَلَمَّا بَلَغَهُ قَوْلُهَا بَكَى وَقَالَ : لَوْلا أَنِّي سَمِعْتُ جَدِّي ، أَوْ حَدَّثَنِي أَبِي ، أَنَّهُ سَمِعَ جَدِّي ، يَقُولُ : " أَيُّمَا رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلاثًا مُبْهَمَةً أَوْ ثَلاثًا عِنْدَ الإِقْرَاءِ ، لَمْ تَحِلَّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ لَرَاجَعْتُهَا " .
Suwaid bin Ghaflah narrates: A woman named Aisha Khath’amiyyah was the wife of Sayyiduna Imam Hasan bin Ali (may Allah be pleased with them both). When Sayyiduna Ali (may Allah be pleased with him) was martyred and allegiance was given to Sayyiduna Imam Hasan (may Allah be pleased with him), this woman said: “Amir al-Mu’minin! Congratulations to you on the caliphate.” So Imam Hasan (may Allah be pleased with him) said: “Sayyiduna Ali (may Allah be pleased with him) has been martyred and you are congratulating me? Go, you are divorced three times.” The narrator states: The woman wrapped herself in her cloak, and when her waiting period (‘iddah) was completed, Sayyiduna Imam Hasan (may Allah be pleased with him) sent her the remainder of her dowry and, along with it, ten thousand (dirhams or dinars) as a gift. The woman said: “This wealth is very little compared to the beloved who has departed.” When Sayyiduna Imam Hasan (may Allah be pleased with him) was informed about this, he wept and said: “If I had not heard my grandfather say this (the narrator is unsure, perhaps these are the words), my father (Sayyiduna Ali, may Allah be pleased with him) narrated this hadith to me, he heard my grandfather (the Prophet Muhammad, peace and blessings be upon him) say: Whoever gives his wife three ambiguous divorces (the narrator is unsure, perhaps these are the words), whoever gives his wife three divorces during three periods of purity, then that woman is not lawful for him until she marries another man and becomes divorced or widowed.” (Imam Hasan says:) Otherwise, I would have taken her back.
