نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، وَنا يُوسُفُ بْنُ سَعِيدٍ ، نَا حَجَّاجٌ ، نَا ابْنُ جُرَيْجٍ ، قَالَ : وَحَدَّثَنِي ابْنُ شِهَابٍ ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ ، أَنَّهَا أَخْبَرَتْهُ " أَنَّهَا كَانَتْ عِنْدَ أَبِي عَمْرِو بْنِ حَفْصِ بْنِ الْمُغِيرَةِ ، فَطَلَّقَهَا آخِرَ ثَلاثِ تَطْلِيقَاتٍ ، فَزَعَمَتْ أَنَّهَا جَاءَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَاسْتَفْتَتْهُ فِي خُرُوجِهَا مِنْ بَيْتِهَا فَأَمَرَهَا أَنْ تَنْتَقِلَ إِلَى بَيْتِ ابْنِ أُمِّ مَكْتُومٍ ، فَأَبَى مَرْوَانُ إِلا أَنْ يَتَّهِمَ فَاطِمَةَ فِي خُرُوجِ الْمُطَلَّقَةِ مِنْ بَيْتِهَا وَزَعَمَ عُرْوَةُ ، أَنَّ عَائِشَةَ أَنْكَرَتْ ذَلِكَ عَلَى فَاطِمَةَ ، وَأَنَّ عَائِشَةَ كَانَتْ تَنْهَى الْمُطَلَّقَةَ أَنْ تَخْرُجَ مِنْ بَيْتِهَا ، حَتَّى تَنْقَضِيَ عِدَّتُهَا " .
Abu Salamah bin Abdur Rahman narrates the statement of Sayyidah Fatimah bint Qais (may Allah be pleased with her): She was the wife of Abu Amr bin Hafs bin Mughira, and he gave her the third divorce. She came to the Prophet (peace be upon him) and asked him about this issue: Can she leave her house (i.e., move to another place)? So the Prophet instructed her: "She should move to the house of Ibn Umm Maktum." Marwan did not accept that a divorced woman can leave her house; he did not consider the statement of Fatimah bint Qais as reliable. Urwah narrates: Sayyidah Aisha also did not accept the statement of Fatimah bint Qais. Sayyidah Aisha (may Allah be pleased with her) used to prohibit a divorced woman from leaving her house until her waiting period ('iddah) was completed.
