نَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الْبَزَّازُ ، نَا الْحَسَنُ بْنُ عَرَفَةَ . ح وَنا أَحْمَدُ بْنُ الْحُسَيْنِ بْنِ مُحَمَّدِ بْنِ أَحْمَدَ بْنِ الْجُنَيْدِ ، نَا زِيَادُ بْنُ أَيُّوبَ ، قَالا : نَا إِسْمَاعِيلُ بْنُ عُلَيَّةَ ، نَا أَيُّوبُ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ ، وَقَالَ ابْنُ عَرَفَةَ : إِنَّ ابْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً وَهِيَ حَائِضٌ ، فَسَأَلَ عُمَرُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَمَرَهُ أَنْ يُرَاجِعَهَا ثُمَّ يُمْهِلَهَا حَتَّى تَحِيضَ حَيْضَةً أُخْرَى ، ثُمَّ يُمْهِلَهَا حَتَّى تَطْهُرَ ، ثُمَّ يُطَلِّقَهَا قَبْلَ أَنْ يَمَسَّهَا ، فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ تُطَلَّقَ لَهَا النِّسَاءُ ، قَالَ : وَكَانَ ابْنُ عُمَرَ إِذَا سُئِلَ عَنِ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ وَهِيَ حَائِضٌ ، يَقُولُ : أَمَّا أَنْتَ طَلَّقْتَهَا طَلْقَةً وَاحِدَةً أَوِ اثْنَتَيْنِ ، فَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَمَرَهُ أَنْ يُرَاجِعَهَا ، ثُمَّ يُمْهِلَهَا حَتَّى تَحِيضَ حَيْضَةً أُخْرَى ، ثُمَّ يُمْهِلَهَا حَتَّى تَطْهُرَ ، ثُمَّ يُطَلِّقَهَا قَبْلَ أَنْ يَمَسَّهَا ، وَأَمَّا أَنْتَ طَلَّقْتَهَا ثَلاثًا فَقَدْ عَصَيْتَ اللَّهَ تَعَالَى فِيمَا أَمَرَكَ بِهِ مِنْ طَلاقِ امْرَأَتِكَ ، وَبَانَتْ مِنْكَ " .
Nafi’ reports: Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) divorced his wife while she was in her menstrual period. The narrator named Ibn ‘Urfa reports: Sayyiduna Abdullah bin Umar gave his wife one divorce while she was in her menstrual period. After this, both narrators transmitted these words: Sayyiduna Umar (may Allah be pleased with him) asked the Prophet (peace and blessings be upon him) about this matter, so the Prophet (peace and blessings be upon him) instructed (Ibn Umar) to take his wife back, then leave her as she is until she experiences her next menstrual period, then leave her as she is until she becomes pure, then before having intercourse with her, divorce her. This is the method about which Allah Almighty has commanded that women should be divorced accordingly. The narrator reports: When Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) was asked about a person who divorced his wife during her menstrual period, Sayyiduna Ibn Umar would say: “If you have given one or two divorces, then the Prophet (peace and blessings be upon him) has instructed regarding such a person that he should take his wife back, then leave her as she is until she experiences her next menstrual period, then leave her as she is until she becomes pure, then before having intercourse with her, divorce her. If you have given your wife three divorces, then you have disobeyed what Allah has commanded you regarding divorcing your wife, and your wife has become irrevocably separated from you.”
