نَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ يَحْيَى بْنِ سَعِيدٍ ، نَا يَحْيَى بْنُ آدَمَ ، نَا عَمَّارُ بْنُ رُزَيْقٍ ، عَنْ أَبِي إِسْحَاقَ ، عَنِ الشَّعْبِيِّ ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ ، قَالَتْ : " طَلَّقَنِي زَوْجِي ثَلاثًا فَأَرَدْتُ النَّفَقَةَ ، فَأَتَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " انْتَقِلِي إِلَى بَيْتِ ابْنِ أُمِّ مَكْتُومٍ " ، قَالَ أَبُو إِسْحَاقَ : فَلَمَّا حَدَّثَ بِهِ الشَّعْبِيُّ حَصَبَهُ الأَسْوَدُ ، وَقَالَ : وَيْحَكَ تُحَدِّثُ ، أَوْ تُفْتِي بِمِثْلِ هَذَا ، قَدْ أَتَتْ عُمَرَ ، فَقَالَ : إِنْ جِئْتِ بِشَاهِدَيْنِ يَشْهَدَانِ أَنَّهُمَا سَمِعَاهُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَإِلا لَمْ نَتْرُكْ كِتَابَ اللَّهِ لِقَوْلِ امْرَأَةٍ لا تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ سورة الطلاق آية 1 الآيَةَ . وَلَمْ يَقُلْ فِيهِ : وَسُنَّةَ نَبِيِّهِ ، وَهَذَا أَصَحُّ مِنَ الَّذِي قَبْلَهُ ، لأَنَّ هَذَا الْكَلامَ لا يُثْبَتُ ، وَيَحْيَى بْنُ آدَمَ أَحْفَظُ مِنْ أَبِي أَحْمَدَ الزُّبَيْرِيِّ وَأَثْبَتُ مِنْهُ ، وَاللَّهُ أَعْلَمُ . وَقَدْ تَابَعَهُ قَبِيصَةُ بْنُ عُقْبَةَ .
Lady Fatimah bint Qais (may Allah be pleased with her) narrates: My husband gave me three divorces. I sought maintenance. I went to the service of the Prophet (peace and blessings be upon him), and he said: "Move to the house of Ibn Umm Maktum (may Allah be pleased with him)." Abu Ishaq narrates: When Sha'bi narrated this narration, Aswad threw pebbles at him and said: Woe to you, are you narrating this narration or giving a fatwa based on it? That woman had also gone to the service of Sayyiduna Umar (may Allah be pleased with him). So Sayyiduna Umar (may Allah be pleased with him) said: If you bring two such witnesses who testify that they heard the Prophet (peace and blessings be upon him) say this, then fine, otherwise we will not abandon the command of Allah's Book because of the statement of one woman (the command is): "Do not expel them from their houses, nor should they leave, except in case they commit a clear immorality." In this narration, the narrator did not mention these words: and will not abandon the Sunnah (command) of our Prophet (peace and blessings be upon him). This narration is more authentic than the previous narration, because these words are not established. The narrator named Yahya is of greater memory and more reliable than Abu Ahmad Zubayri.
