نَا أَبُو بَكْرٍ ، نَا مُحَمَّدُ بْنُ عَلِيٍّ السَّرَخْسِيُّ ، نَا عَلِيُّ بْنُ عَاصِمٍ ، نَا خَالِدٌ ، وَهِشَامٌ ، عَنْ مُحَمَّدٍ ، عَنْ خَالِدٍ الْحَذَّاءِ ، قَالَ : قُلْتُ لابْنِ عُمَرَ : رَجُلٌ طَلَّقَ حَائِضًا ؟ ، قَالَ : أَتَعْرِفُ ابْنَ عُمَرَ ؟ فَإِنَّهُ طَلَّقَ حَائِضًا ، فَسَأَلَ عُمَرُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " قُلْ لَهُ فَلْيُرَاجِعْهَا فَإِذَا حَاضَتْ ثُمَّ طَهُرَتْ ، فَإِنْ شَاءَ طَلَّقَ ، وَإِنْ شَاءَ أَمْسَكَ " ، قُلْتُ : اعْتَدَدْتَ بِتِلْكَ التَّطْلِيقَةِ ؟ قَالَ : نَعَمْ .
Jabir Haza reports: I asked Sayyiduna Abdullah bin Umar (may Allah be pleased with them both): If a man divorces a woman during her menstruation, what is the ruling? Sayyiduna Ibn Umar replied: "Do you know about Ibn Umar? He divorced his wife while she was menstruating." Sayyiduna Umar asked the Prophet Muhammad (peace and blessings be upon him) about this matter, so the Prophet (peace and blessings be upon him) said: "Tell him to take her back, then when she experiences (the next) menstruation, and after she becomes pure, if he wishes, he may divorce her, and if he wishes, he may keep her with him." The narrator says: I asked (Sayyiduna Ibn Umar, may Allah be pleased with them both): "Did you count that as one divorce?" He replied: "Yes."
