Hadith 3904

نَا ابْنُ صَاعِدٍ ، نَا عَمْرُو بْنُ عَلِيٍّ ، نَا بِشْرُ بْنُ الْمُفَضَّلِ ، عَنْ عُبَيْدِ اللَّهِ ، عَنْ نَافِعٍ ، أَنَّ ابْنَ عُمَرَ أَخْبَرَهُ ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ تَطْلِيقَةً ، فَاسْتَفْتَى عُمَرُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " إِنَّ عَبْدَ اللَّهِ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ ، فَقَالَ : مُرْ عَبْدَ اللَّهِ فَلْيُرَاجِعْهَا ، ثُمَّ يُمْسِكْهَا حَتَّى تَطْهُرَ مِنْ حَيْضَتِهَا هَذِهِ ، فَإِذَا حَاضَتْ أُخْرَى وَطَهُرَتْ ، فَإِنْ شَاءَ فَلْيُطَلِّقْهَا قَبْلَ أَنْ يُجَامِعَهَا ، وَإِنْ شَاءَ فَلْيُمْسِكْهَا فَإِنَّهَا الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ أَنْ تُطَلَّقَ لَهَا النِّسَاءُ " ، وَكَذَلِكَ قَالَ صَالِحُ بْنُ كَيْسَانَ ، وَمُوسَى بْنُ عُقْبَةَ ، وَإِسْمَاعِيلُ بْنُ أُمَيَّةَ ، وَلَيْثُ بْنُ سَعْدٍ ،وَابْنُ أَبِي ذِئْبٍ ، وَابْنُ جُرَيْجٍ ، وَجَابِرٌ ، وَإِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ بْنِ عُقْبَةَ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنَّهُ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً وَاحِدَةً . وَكَذَلِكَ قَالَ الزُّهْرِيُّ ، عَنْ سَالِمٍ ، عَنْ أَبِيهِ ، وَيُونُسُ بْنُ جُبَيْرٍ ، وَالشَّعْبِيُّ ، وَالْحَسَنُ.
Abdullah bin Umar (may Allah be pleased with them both) narrates: He divorced his wife while she was in her menstrual period. Umar (may Allah be pleased with him) asked the Prophet (peace be upon him) about its ruling. He said: "Abdullah has divorced his wife while she was in her menstrual period." The Prophet (peace be upon him) said: "Tell Abdullah to take her back and keep her with him until she becomes pure from this menstruation. Then, when she gets her next menstruation and becomes pure after it, at that time, if he wishes, he may divorce her before having intercourse with her, and if he wishes, he may keep her with him. This is the method about which Allah has commanded that women should be divorced according to it."
Salih bin Kaysan, Musa bin Uqbah, Ismail bin Umayyah, Layth bin Sa'd, Ibn Abi Dhi'b, Ibn Jurayj, Jabir, and Ismail bin Ibrahim have narrated this from Nafi' from Abdullah bin Umar (may Allah be pleased with them both), that he gave one divorce. Zuhri has narrated the same from Salim from his father (Abdullah bin Umar, may Allah be pleased with them both). Yunus bin Jubair, Sha'bi, and Hasan Basri have also narrated the same.
