نَا نَا أَبُو عَلِيٍّ الْمَالِكِيُّ ، نَا أَبُو حَفْصٍ عَمْرُو بْنُ عَلِيٍّ ، نَا يَحْيَى بْنُ سَعِيدٍ ، نَا ثَوْرُ بْنُ يَزِيدَ ، قَالَ : سَمِعْتُ رَجَاءَ بْنَ حَيْوَةَ ، قَالَ : سُئِلَ عَمْرُو بْنُ الْعَاصِ ، " عَنْ عِدَّةِ أُمِّ وَلَدٍ ، فَقَالَ : لا تَلْبَسُوا عَلَيْنَا دِينَنَا ، إِنْ تَكُنْ أَمَةً فَإِنْ عِدَّتَهَا عِدَّةُ حُرَّةٍ " ، وَرَوَاهُ سُلَيْمَانُ بْنُ مُوسَى ، عَنْ رَجَاءِ بْنِ حَيْوَةَ ، عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ ، عَنْ عَمْرِو بْنِ الْعَاصِ مَوْقُوفًا أَيْضًا . وَرَفَعَهُ قَتَادَةُ ، وَمَطَرٌ الْوَرَّاقُ . وَالْمَوْقُوفُ أَصَحُّ وَقَبِيصَةُ لَمْ يَسْمَعْ مِنْ عَمْرٍو .
Raja bin Haywah narrates: It was asked from Sayyiduna Amr bin al-As (may Allah be pleased with him) about the waiting period (‘iddah) of an umm walad, so he replied: "Do not mix up religious rulings before us. If she were considered a slave-girl, then her waiting period would be like that of a free woman." The same narration is also transmitted with another chain as a mawquf narration up to Sayyiduna Amr bin al-As (may Allah be pleased with him). Qatadah and Matar have transmitted this narration as a marfu‘ hadith, but its mawquf status is correct. The narrator named Qabeesah did not hear hadiths from Sayyiduna Amr bin al-As (may Allah be pleased with him).
