Hadith 3835

نَا نَا دَعْلَجٌ ، نَا مُحَمَّدُ بْنُ عَلِيِّ بْنِ زَيْدٍ ، نَا سَعِيدُ بْنُ مَنْصُورٍ ، نَا هُشَيْمٌ ، عَنْ جُوَيْبِرٍ ، عَنِ الضَّحَّاكِ ، أَنَّ عَلِيًّا ، قَالَ : " إِذَا وَطِئَهَا وَجَبَتْ عَلَيْهِ ، وَإِذَا رَأَى عَيْبًا قَبْلَ أَنْ يَطَأَهَا ، فَإِنْ شَاءَ أَمْسَكَ ، وَإِنْ شَاءَ رَدَّ " ، هَذَا مُرْسَلٌ.
Sayyiduna Ali (may Allah be pleased with him) said: "When a man (the buyer) has intercourse with the slave girl, then the transaction is finalized. But if the buyer finds a defect in her before having intercourse, then he has the option: if he wishes, he may keep her, and if he wishes, he may return her." This narration is mursal.
