نَا نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا الْعَبَّاسُ بْنُ الْوَلِيدِ بْنِ مَزْيَدٍ ، نَا عُقْبَةُ بْنُ عَلْقَمَةَ ، أَخْبَرَنِي مُسْلِمُ بْنُ خَالِدٍ ، حَدَّثَنِي جَعْفَرُ بْنُ مُحَمَّدٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، عَنْ حُسَيْنِ بْنِ عَلِيٍّ ، أَنَّ عَلِيَّ بْنَ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ ، كَانَ يَقُولُ " فِي الرَّجُلِ يَبْتَاعُ الْجَارِيَةَ فَيُصِيبُهَا ، ثُمَّ يَظْهَرُ عَلَى عَيْبٍ فِيهَا لَمْ يَكُنْ رَآهُ أَنَّ الْجَارِيَةَ تَلْزَمُهُ ، وَيُوضَعُ عَنْهُ قَدْرُ الْعَيْبِ ، وَقَالَ : لَوْ كَانَ كَمَا يَقُولُ النَّاسُ ، يَرُدُّهَا وَيَرُدُّ الْعَقْرَ كَانَ ذَلِكَ شِبْهَ الإِجَارَةِ ، وَكَانَ الرَّجُلُ يُصِيبُهَا ، وَهُوَ يَرَى الْعَيْبَ لَمْ يَرُدِّ الْعَقْرَ ، وَلَكِنَّهُ إِذَا أَصَابَهَا لَزِمَتْهُ الْجَارِيَةُ ، وَوُضِعَ عَنْهُ قَدْرُ الْعَيْبِ " .
Imam Ja'far al-Sadiq (may Allah have mercy on him) narrates from his father (Imam Baqir, may Allah be pleased with him), who narrates from his grandfather (Imam Zain al-Abidin, may Allah have mercy on him), who narrates the following statement of Imam Husayn (may Allah be pleased with him): Sayyiduna Ali (may Allah be pleased with him), regarding a person who bought a slave-girl, had intercourse with her, and then discovered a defect in her, said: "The slave-girl will remain with that person, and the price will be reduced according to the extent of the defect." Sayyiduna Ali (may Allah be pleased with him) said: "If the ruling were as some people say, then that person would return the woman and also pay 'aqr (the compensation paid in case of intercourse due to doubt), and this would resemble hiring. Thus, it would be as if, when he had intercourse with the slave-girl, he had already seen the defect and then paid 'aqr as compensation. But (the ruling is) when he has intercourse with the slave-girl, she becomes his, and the price is reduced according to the defect."
