Hadith 3673

نَا نَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا عِيسَى بْنُ أَبِي حَرْبٍ ، نَا يَحْيَى بْنُ أَبِي بُكَيْرٍ ، نَا شُعْبَةُ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، قَالَ : " قَضَى عُمَرُ فِي الْبَرْصَاءِ ، وَالْجَذْمَاءِ ، وَالْمَجْنُونَةِ ، إِذَا دُخِلَ بِهَا فُرِّقَ بَيْنَهُمَا ، وَالصَّدَاقُ لَهَا لِمَسِيسِهِ إِيَّاهَا ، وَهُوَ لَهُ عَلَى وَلِيِّهَا ، قَالَ : قُلْتُ : أَنْتَ سَمِعْتَهُ ؟ ، قَالَ : نَعَمْ " .
Saeed bin Musayyib narrates: Sayyiduna Umar (may Allah be pleased with him) gave the verdict regarding a woman afflicted with leukoderma, leprosy, or insanity that if her husband has intercourse with her, then separation will be established between the husband and wife. The woman will receive the dowry because of the husband's intercourse, and the man will recover that dowry from the woman's guardian.
