Hadith 3615

نَا أَبُو مُحَمَّدِ بْنُ صَاعِدٍ ، نَا أَحْمَدُ بْنُ مَنْصُورٍ ، نَا إِسْمَاعِيلُ بْنُ عَبْدِ اللَّهِ بْنِ زُرَارَةَ الرَّقِّيُّ ، نَا مُحَمَّدُ بْنُ الْحَسَنِ الْمَدَائِنِيُّ ، نَا الْحَسَنُ بْنُ أَبِي الْحَسَنِ ، عَنْ عَبْدِ اللَّهِ بْنِ الْمُغَفَّلِ ، قَالَ : " تَزَوَّجَ رَجُلٌ مِنَ الأَنْصَارِ امْرَأَةً فِي مَرَضِهِ ، فَقَالُوا : لا يَجُوزُ وَهَذِهِ مِنَ الثُّلُثِ ، فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : النِّكَاحُ جَائِزٌ ، وَلا يَكُونُ مِنَ الثُّلُثِ " .
Sayyiduna Abdullah bin Mughaffal (may Allah be pleased with him) narrates: An Ansari married a woman during his illness. People said: "This is not permissible and this (inheritance) will be counted in the one-third portion." This matter was presented before the Prophet (peace and blessings of Allah be upon him), so he said: "This marriage is permissible and it will not be counted in the one-third portion."
