نَا عُثْمَانُ بْنُ أَحْمَدَ الدَّقَّاقُ ، نَا أَبُو سَعِيدٍ الْهَرَوِيُّ يَحْيَى بْنُ مَنْصُورٍ ، نَا سُوَيْدُ بْنُ نَصْرٍ ، نَا ابْنُ الْمُبَارَكِ ، عَنْ مَعْمَرٍ ، حَدَّثَنِي صَالِحُ بْنُ كَيْسَانَ ، عَنْ نَافِعِ بْنِ جُبَيْرٍ ، عَنِ ابْنِ عَبَّاسٍ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لَيْسَ لِلْوَلِيِّ مَعَ الثَّيِّبِ أَمْرٌ ، وَالْيَتِيمَةُ تُسْتَأْمَرُ ، وَصَمْتُهَا رِضَاهَا " ، كَذَا رَوَاهُ مَعْمَرٌ عَنْ صَالِحٍ وَالَّذِي قَبْلَهُ أَصَحُّ فِي الإِسْنَادِ وَالْمَتْنِ ، لأَنَّ صَالِحًا لَمْ يَسْمَعْهُ مِنْ نَافِعِ بْنِ جُبَيْرٍ ، وَإِنَّمَا سَمِعَهُ مِنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ عَنْهُ ، اتَّفَقَ عَلَى ذَلِكَ ابْنُ إِسْحَاقَ ، وَسَعِيدُ بْنُ سَلَمَةَ ، عَنْ صَالِحٍ ، سَمِعْتُ النَّيْسَابُورِيَّ ، يَقُولُ : الَّذِي عِنْدِي أَنَّ مَعْمَرًا أَخْطَأَ فِيهِ.
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said: "The guardian has no authority over a previously married woman, and the consent of a virgin will be sought; her silence is her consent." Mu'ammar has transmitted it in the same way. The narration that has passed before this is more correct in terms of chain and text, because the narrator named Salih did not hear it from Nafi' bin Jubayr; he heard it from Abdullah bin Fadl. Ibn Ishaq and Sa'id bin Salamah agree in transmitting this from Salih. I heard Shaykh Abu Bakr Nishapuri saying: "In my view, Mu'ammar has erred in this matter."
