نَا نَا أَبُو طَاهِرٍ الْقَاضِي مُحَمَّدُ بْنُ أَحْمَدَ ، نَا مُحَمَّدُ بْنُ يَحْيَى بْنِ سُلَيْمَانَ ، نَا أَبُو طَالِبٍ عَبْدُ الْجَبَّارِ بْنُ عَاصِمٍ ، حَدَّثَنِي عُبَيْدُ اللَّهِ بْنُ عَمْرٍو ، عَنْ عَبْدِ الْمَلِكِ بْنِ عِقَابٍ ، وَأَبِي حَنِيفَةَ ، عَنْ سِمَاكِ بْنِ حَرْبٍ ، قَالَ : جَاءَ رَجُلٌ إِلَى عَلِيٍّ عَلَيْهِ السَّلامُ ، فَقَالَ : " امْرَأَةٌ أَنَا وَلِيُّهَا تَزَوَّجَتْ بِغَيْرِ إِذْنِي ، فَقَالَ عَلِيُّ عَلَيْهِ السَّلامُ : " تَنْظُرُ فِيمَا صَنَعَتْ إِذَا كَانَتْ تَزَوَّجَتْ كُفُؤًا أَجَزْنَا ذَلِكَ لَهَا ، وَإِنْ كَانَتْ تَزَوَّجَتْ مَنْ لَيْسَ لَهَا بِكُفُؤٍ جَعَلْنَا ذَلِكَ إِلَيْكَ " .
Simak bin Harb narrates: A man came to Sayyiduna Ali (may Allah be pleased with him) and said: "There is a girl, I am her guardian, and she has married without my permission." So Sayyiduna Ali (may Allah be pleased with him) said: "Regarding what this girl has done, our opinion is that if she has married someone of equal status (kufu’), then we will let it stand; but if she has married someone who is not her equal, then we will give you (the guardian) the choice (to let it stand or annul it)."
