قُرِئَ عَلَى أَبِي مُحَمَّدِ بْنِ صَاعِدٍ ، وَأَنَا أَسْمَعُ حَدَّثَكُمْ عُبَيْدُ اللَّهِ بْنُ سَعْدٍ الزُّهْرِيُّ ، نَا عَمِّي ، نَا أَبِي ، عَنِ ابْنِ إِسْحَاقَ ، حَدَّثَنِي عُمَرُ بْنُ حُسَيْنٍ مَوْلَى آلِ حَاطِبٍ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، قَالَ : تُوُفِّيَ عُثْمَانُ بْنُ مَظْعُونٍ وَتَرَكَ بِنْتًا لَهُ مِنْ خَوْلَةَ بِنْتِ حَكِيمِ بْنِ أُمَيَّةَ ، فَأَوْصَى إِلَى أَخِيهِ قُدَامَةَ بْنِ مَظْعُونٍ وَهُمَا خَالايَ فَخَطَبْتُ إِلَى قُدَامَةَ بِنْتَ عُثْمَانَ فَزَوَّجَنِيهَا ، فَدَخَلَ الْمُغِيرَةُ إِلَى أُمِّهَا فَأَرْغَبَهَا فِي الْمَالِ فَحَطَّتْ إِلَيْهِ وَحَطَّتِ الْجَارِيَةُ إِلَى هَوَى أُمِّهَا ، حَتَّى ارْتَفَعَ أَمْرُهُمْ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ قُدَامَةُ : يَا رَسُولَ اللَّهِ ، " ابْنَةُ أَخِي وَأَوْصَى بِهَا إِلَيَّ فَزَوَّجْتُهَا ابْنَ عَمٍّ وَلَمْ أُقَصِّرْ بِالصَّلاحِ وَالْكَفَاءَةِ ، وَلَكِنَّهَا امْرَأَةٌ وَأَنَّهَا حَطَّتْ إِلَى هَوَى أُمِّهَا ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : هِيَ يَتِيمَةٌ وَلا تُنْكَحُ إِلا بِإِذْنِهَا ، فَانْتُزِعَتْ مِنِّي وَاللَّهِ بَعْدَ أَنْ مَلَكْتُهَا ، فَزَوَّجُوهَا الْمُغِيرَةِ بْنَ شُعْبَةَ " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates: Sayyiduna Uthman bin Maz'un (may Allah be pleased with him) passed away, leaving behind a daughter whose mother was Sayyida Khawla bint Hakim. Sayyiduna Uthman bin Maz'un had made a bequest to his brother, Sayyiduna Qudamah bin Maz'un. Both of these gentlemen were my maternal uncles. I sent a marriage proposal to Sayyiduna Qudamah bin Maz'un for the daughter of Sayyiduna Uthman bin Maz'un, and he agreed to marry her to me. Then Sayyiduna Mughirah (may Allah be pleased with him) went to the girl's mother and offered her more wealth, so the woman inclined towards him. The girl also preferred her mother's wish. Their matter was presented before the Prophet Muhammad (peace and blessings be upon him). Sayyiduna Qudamah said: "O Messenger of Allah! She is my niece. My brother had entrusted her to me. I married her to Ibn Umar. I did not fall short in seeking her welfare or in matching her in lineage, but she is preferring her mother's wish." The Prophet Muhammad (peace and blessings be upon him) said: "She is a girl; she cannot be married without her consent." (Ibn Umar says:) By Allah, I had become her husband (i.e., the marriage had taken place, but due to the statement of the Prophet Muhammad, peace and blessings be upon him), she was separated from me and her family married her to Sayyiduna Mughirah bin Shu'bah (may Allah be pleased with him).
