نَا أَبُو مُحَمَّدِ بْنُ صَاعِدٍ ، نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ الْحَكَمِ الْمِصْرِيُّ ، وَأَحْمَدُ بْنُ الْفَرَحِ بْنِ سُلَيْمَانَ أَبُو عُتْبَةَ الْحِمْصِيُّ ، قَالا : نَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ بْنِ أَبِي فُدَيْكٍ ، نَا ابْنُ أَبِي ذِئْبٍ ، عَنْ عُمَرَ بْنِ حُسَيْنٍ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنَّهُ تَزَوَّجَ بِنْتَ خَالِهِ عُثْمَانَ بْنِ مَظْعُونٍ ، قَالَ : فَذَهَبَتْ أُمُّهَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَتْ : إِنَّ ابْنَتِي تَكْرَهُ ذَلِكَ " فَأَمَرَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُفَارِقَهَا فَفَارَقَهَا ، وَقَالَ : لا تَنْكِحُوا الْيَتَامَى حَتَّى تَسْتَأْمِرُوهُنَّ ، فَإِذَا سَكَتَتْ فَهُوَ إِذْنُهَا ، فَتَزَوَّجَهَا بَعْدُ عَبْدُ اللَّهِ الْمُغِيرَةُ بْنُ شُعْبَةَ " ، وَرَوَاهُ الْوَلِيدُ بْنُ مُسْلِمٍ وَصَدَقَةُ بْنُ عَبْدِ اللَّهِ ، عَنِ ابْنِ أَبِي ذِئْبٍ ، عَنْ نَافِعٍ مُخْتَصَرًا ، مُرْسَلا . وَابْنُ أَبِي ذِئْبٍ لَمْ يَسْمَعْهُ مِنْ نَافِعٍ ، وَإِنَّمَا رَوَاهُ ، عَنْ عُمَرَ بْنِ حُسَيْنٍ عَنْهُ.
It is narrated about Sayyiduna Abdullah bin Umar (may Allah be pleased with them): He married the daughter of his maternal uncle, Sayyiduna Uthman bin Maz'un (may Allah be pleased with him). Sayyiduna Ibn Umar (may Allah be pleased with them) states: The mother of this girl came to the service of the Noble Prophet (peace and blessings be upon him) and said, "My daughter dislikes this marriage." So the Noble Prophet (peace and blessings be upon him) instructed Sayyiduna Ibn Umar (may Allah be pleased with them) to separate from that woman (i.e., to divorce her), so Sayyiduna Ibn Umar (may Allah be pleased with them) separated from her. The Noble Prophet (peace and blessings be upon him) said: "Do not marry off girls until their opinion is sought; if they remain silent (in response), then that is considered their permission." The narrator states: Later, Sayyiduna Mughirah bin Shu'bah (may Allah be pleased with him) married that girl. The same narration is also transmitted with another chain, in a brief and mursal form, from Nafi'. The narrator named Ibn Abi Wahb did not hear this from Nafi'; he narrated it from Nafi' through 'Umar bin Husayn.
