نَا ابْنُ أَبِي دَاوُدَ ، نَا أَحْمَدُ بْنُ صَالِحٍ ، نَا عَبْدُ الرَّزَّاقِ ، أنا ابْنُ جُرَيْجٍ ، حَدَّثَنِي سُلَيْمَانُ بْنُ مُوسَى ، أَنَّ ابْنَ شِهَابٍ أَخْبَرَهُ ، أَنَّ عُرْوَةَ أَخْبَرَهُ ، أَنَّ عَائِشَةَ أَخْبَرَتْهُ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذْنِ وَلِيِّهَا فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ ، فَإِنْ دَخَلَ بِهَا فَالْمَهْرُ لَهَا بِمَا أَصَابَ مِنْهَا ، فَإِنْ تَشَاجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لا وَلِيَّ لَهُ " .
Lady Aisha (may Allah be pleased with her) narrates that the Noble Prophet (peace and blessings be upon him) said: "Any woman who marries without the permission of her guardian, her marriage is invalid, her marriage is invalid, her marriage is invalid. If the man has intercourse with her, then because of this act, the woman will receive the dowry. If there is a dispute between them, then whoever has no guardian, the ruler of the time is her guardian."
