نَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ مِنْ أَصْلِهِ ، نَا جَعْفَرُ بْنُ مُحَمَّدِ بْنِ حَمَّادٍ الْقَلانِسِيُّ ، نَا آدَمُ ، نَا شُعْبَةُ ، عَنْ مُحَمَّدِ بْنِ زِيَادٍ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الدَّابَّةُ جُرْحُهَا جُبَارٌ ، وَالْبِئْرُ جُبَارٌ ، وَالْمَعْدِنُ جُبَارٌ ، وَالرِّجْلُ جُبَارٌ ، وَفِي الرِّكَازِ الْخُمُسُ " ، كَذَا قَالَ : وَالرِّجْلُ جُبَارٌ " ، وَهُوَ وَهْمٌ ، وَلَمْ يُتَابِعْهُ عَلَيْهِ أَحَدٌ عَنْ شُعْبَةَ.
Sayyiduna Abu Huraira (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: “The injury caused by an animal will be without liability, the blood of one who dies by falling into a well will be without liability, the blood of one who dies by being buried in a mine will be without liability, the blood of one who dies by being kicked (by an animal) will be without liability, and payment of one-fifth is obligatory in the case of rikaz (buried treasure).” The narrator has mentioned the kicking (by an animal) in this way, but this is a mistake; no one has followed Shu’bah in transmitting this word.
