نَا ابْنُ صَاعِدٍ ، نَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الدَّوْرَقِيُّ ، نَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ ، عَنْ سُفْيَانَ ، عَنْ مَنْصُورٍ ، عَنْ إِبْرَاهِيمَ ، عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ ، " أَنَّ امْرَأَتَيْنِ ضَرَبَتْ إِحْدَاهُمَا الأُخْرَى بِعَمُودِ فُسْطَاطٍ فَقَتَلَتْهَا ، فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالدِّيَةِ عَلَى عَصَبَةِ الْقَاتِلَةِ وَفِيمَا فِي بَطْنِهَا غُرَّةً ، فَقَالَ الأَعْرَابِيُّ : أَنَدِي مَنْ لا أَكَلَ ، وَلا شَرِبَ ، وَلا صَاحَ ، وَاسْتَهَلَّ ؟ فَمِثْلُ ذَلِكَ بَطَلَ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَسَجْعٌ كَسَجْعِ الأَعْرَابِ، وَقَضَى فِيمَا فِي بَطْنِهَا غُرَّةً " .
Sayyiduna Mughira bin Shu’bah (may Allah be pleased with him) narrates: There were two women, one of whom struck the other with a tent pole and killed her. The Prophet (peace and blessings be upon him) imposed the payment of blood money for the murdered woman upon the family of the woman who killed, and ordered the payment of compensation for the unborn child in the womb of the murdered woman. A Bedouin said: “Should I pay compensation for one who has neither eaten nor drunk, nor has he cried out with a scream? Such blood is wasted.” The Prophet (peace and blessings be upon him) said: “You are speaking in the rhymed prose of the Bedouins.” The Prophet (peace and blessings be upon him) made the payment of compensation for the unborn child in the woman’s womb obligatory.
