نَا أَبُو مُحَمَّدِ بْنُ صَاعِدٍ ، وَأَحْمَدُ بْنُ الْحُسَيْنِ بْنِ الْجُنَيْدِ ، قَالا : نَا يُوسُفُ بْنُ مُوسَى الْقَطَّانُ ، نَا جَرِيرُ بْنُ عَبْدِ الْحَمِيدِ ، عَنْ مَنْصُورٍ ، عَنْ إِبْرَاهِيمَ ، عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ ، عَنِ الْمُغِيرَةِ ، قَالَ : " ضَرَبَتِ امْرَأَةٌ ضَرَّتَهَا بِعَمُودِ الْفُسْطَاطِ وَهِيَ حُبْلَى فَقَتَلَتْهَا ، قَالَ : وَإِحْدَاهُمَا لِحْيَانِيَّةٌ ، قَالَ : فَجَعَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ دِيَةَ الْمَقْتُولَةِ عَلَى عَصَبَةِ الْقَاتِلَةِ ، وَغُرَّةً لَمَا فِي بَطْنِهَا ، قَالَ : فَقَالَ رَجُلٌ مِنْ عَصَبَةِ الْقَاتِلَةِ : أَنَغْرَمُ دِيَةَ مَنْ لا أَكَلَ ، وَلا شَرِبَ ، وَلا اسْتَهَلَّ فَمِثْلُ ذَلِكَ بَطَلَ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَسَجْعٌ كَسَجْعِ الأَعْرَابِ ، وَجَعَلَ عَلَيْهِمَا الدِّيَةَ " .
Sayyiduna Mughira bin Shu’bah (may Allah be pleased with him) narrates: A woman struck her co-wife with a tent pole; the other woman was pregnant. The narrator states: One of these two women belonged to Banu Lahyan. So the Prophet (peace and blessings of Allah be upon him) imposed the payment of blood money for the murdered woman upon the family of the killer woman, and ordered the payment of compensation for the child that was in the womb of the murdered woman. Then a man from the family of the killer woman said: “Shall we pay compensation for a child who has neither eaten nor drunk, who has not cried (i.e., was not born)? Such blood is wasted.” So the Prophet (peace and blessings of Allah be upon him) said: “Are you speaking in the rhymed prose of the Bedouins?” The narrator says: The Prophet (peace and blessings of Allah be upon him) made the payment of blood money obligatory in this case.
