كَتَبَ إِلَيْنَا أَحْمَدُ بْنُ عُمَيْرِ بْنِ يُوسُفَ ، نَا مُحَمَّدُ بْنُ هِشَامٍ الْبَعْلَبَكِّيُّ ، نَا سُوَيْدُ بْنُ عَبْدِ الْعَزِيزِ ، نَا سُفْيَانُ بْنُ حُسَيْنٍ الْوَاسِطِيُّ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، " سُئِلَ عَنِ اللُّقَطَةِ تُوجَدُ فِي الأَرْضِ الْمَسْكُونَةِ وَالسَّبِيلِ الْمِيتَاءِ ، فَقَالَ : عَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلا فَهِيَ لَكَ ، وَسُئِلَ عَنِ اللُّقَطَةِ تُوجَدُ فِي أَرْضِ الْعَدُوِّ ، فَقَالَ : فِيهَا وَفِي الرِّكَازِ الْخُمُسُ ، قَالَ : وَسُئِلَ عَنْ ضَالَّةِ الْغَنَمِ ، فَقَالَ : إِنَّهَا هِيَ لَكَ أَوْ لأَخِيكَ أَوْ لِلذِّئْبِ ، قَالَ : وَسُئِلَ عَنْ ضَالَّةِ الإِبِلِ ، فَقَالَ : دَعْهَا فَإِنَّ مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا ، تَرِدُ الْمَاءَ وَتَأْكُلُ مِنَ الشَّجَرِ ، قَالَ : وَسُئِلَ عَنْ حَرِيسَةِ الْجَبَلِ ، قَالَ : يُضْرَبُ ضَرَبَاتٍ وَيُضَعَّفُ عَلَيْهِ الْغُرْمُ ، وَقَالَ : إِذَا كَانَ مِنَ الْمِرَاحِ فَبَلَغَ ثَمَنَ الْمِجَنِّ وَهُوَ الدِّينَارُ فَفِيهِ الْقَطْعُ ، فَإِذَا كَانَ دُونَ ذَلِكَ ضُرِبَ ضَرَبَاتٍ وَأُضْعِفَ عَلَيْهِ الْغُرْمُ ، وَسُئِلَ عَنِ الثَّمَرِ فِي أَكْمَامِهَا ، قَالَ : يُضْرَبُ ضَرَبَاتٍ وَيُضَعَّفُ عَلَيْهِ الْغُرْمُ ، قَالَ : فَإِذَا كَانَ مِنَ الْجَرِينِ فَبَلَغَ ثَمَنَ الْمِجَنِّ وَهُوَ الدِّينَارُ فَفِيهِ الْقَطْعُ ، فَإِذَا كَانَ دُونَ ذَلِكَ ضُرِبَ ضَرَبَاتٍ وَأُضْعِفَ عَلَيْهِ الْغُرْمُ " .
Amr bin Shu'aib narrates from his father, from his grandfather: The Prophet Muhammad (peace be upon him) was asked about something found in a residential area or a public pathway. He said: "Announce it for one year; if its owner comes, then fine, otherwise it will be yours." The Prophet Muhammad (peace be upon him) was asked about something found in enemy territory, and he said: "From it and from buried treasure (rikaz), one-fifth is due (to the public treasury)." The narrator says: The Prophet Muhammad (peace be upon him) was asked about a lost goat, and he said: "Take hold of it, for it will either be for you, or for your brother, or for the wolf." The Prophet Muhammad (peace be upon him) was asked about a lost camel, and he said: "Leave it, its feet and its stomach are with it; it will reach water on its own and eat from the trees." (The narrator says) The Prophet Muhammad (peace be upon him) was asked about one who steals from the mountain, and he said: "He should be beaten thoroughly and made to pay double the amount." If an animal is stolen from a place where livestock are kept and its value is equal to the value of a shield, that is, one dinar, then the hand should be cut off for it. He was asked about stealing fruit from the cluster, and he said: "That thief should be beaten and made to pay double the amount." He said: "If dates are stolen from the drying place, and the value of the stolen goods is equal to the value of a shield, then the hand should be cut off for it, and if it is less than that, then (the thief) should be beaten and made to pay double the amount."
