نَا أَبُو بَكْرٍ ، نَا يُونُسُ ، نَا ابْنُ وَهْبٍ ، أَخْبَرَنِي رِجَالٌ مِنْ أَهْلِ الْعِلْمِ مِنْهُمْ مَالِكُ بْنُ أَنَسٍ ، وَيُونُسُ بْنُ يَزِيدَ ، عَنِ الزُّهْرِيِّ ، عَنْ حَرَامِ بْنِ سَعِيدِ بْنِ مُحَيِّصَةَ ، أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ ، فَكُلِّمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِكَ ، فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى أَهْلِ الْحَوَائِطِ ، حِفْظَهَا بِالنَّهَارِ ، وَأَنَّ مَا أَفْسَدَتِ الْمَوَاشِي بِاللَّيْلِ ضَامِنٌ عَلَى أَهْلِهَا " ، وَكَذَلِكَ رَوَاهُ صَالِحُ بْنُ كَيْسَانَ ، وَاللَّيْثُ ، وَمُحَمَّدُ بْنُ إِسْحَاقَ ، وَعُقَيْلٌ ، وَشُعَيْبٌ ، وَمَعْمَرٌ ، مِنْ غَيْرِ رِوَايَةِ عَبْدِ الرَّزَّاقِ . وَقَالَ ابْنُ عُيَيْنَةَ وَسُفْيَانُ بْنُ حُسَيْنٍ عَنِ الزُّهْرِيِّ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَحَرَامٍ ، جَمِيعًا أَنَّ نَاقَةً لِلْبَرَاءِ . وَقَالَ قَتَادَةُ عَنِ الزُّهْرِيِّ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَحْدَهُ ، وَقَالَ ابْنُ جُرَيْجٍ عَنِ الزُّهْرِيِّ عَنْ أَبِي أُمَامَةَ بْنِ سَهْلِ بْنِ حُنَيْفٍ ، أَنَّ نَاقَةً لِلْبَرَاءِ ، قَالَهُ الْحَجَّاجُ ، وَعَبْدُ الرَّزَّاقِ عَنْهُ.
Haram bin Sa'd bin Muhaisah reports: The she-camel of Sayyiduna Bara’ (may Allah be pleased with him) entered a garden and caused damage (to the produce) there. A complaint was made to the Prophet Muhammad (peace and blessings be upon him) about this, so he (peace be upon him) gave this ruling: "The protection of gardens during the day is the responsibility of their owners, and any damage caused by livestock at night, its compensation will be the responsibility of the owners of those animals." This narration is also transmitted with some other chains of transmission.
