Hadith 3314

نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا يُونُسُ بْنُ عَبْدِ الأَعْلَى ، نَا أَيُّوبُ بْنُ سُوَيْدٍ ، عَنِ الأَوْزَاعِيِّ ، عَنِ الزُّهْرِيِّ ، عَنْ حَرَامِ بْنِ مُحَيِّصَةَ ، عَنِ الْبَرَاءِ بْنِ عَازِبٍ ، " أَنَّ نَاقَةً لِرَجُلٍ مِنَ الأَنْصَارِ دَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ ، فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى أَهْلِ الْحَوَائِطِ حِفْظَهَا بِالنَّهَارِ ، وَعَلَى أَهْلِ الْمَوَاشِي مَا أَفْسَدَتْ مَاشِيَتُهُمْ بِاللَّيْلِ " ، قَالَ يُونُسُ : سَمِعَهُ الشَّافِعِيُّ ، مِنْ أَيُّوبَ ، لأَنَّهُ قَالَ : عَنِ الزُّهْرِيِّ ، عَنْ حَرَامٍ ، عَنِ الْبَرَاءِ ، .
Sayyiduna Bara’ bin Azib (may Allah be pleased with him) reports: An Ansari’s she-camel entered a garden and caused damage there, so the Noble Prophet (peace and blessings be upon him) gave this ruling: “The owners of gardens are responsible for their protection during the day, while the owners of livestock are responsible for what their animals damage during the night.” Yunus reports: Shafi’i heard this narration from Ayyub, but he narrated it from Zuhri, from Haram, from Sayyiduna Bara’ (may Allah be pleased with him).
