وَنا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا أَبُو الأَزْهَرِ ، وَأَحْمَدُ بْنُ يُوسُفَ السُّلَمِيُّ ، قَالا : نَا عَبْدُ الرَّزَّاقِ ، نَا مَعْمَرٌ ، عَنِ الزُّهْرِيِّ ، عَنْ حَرَامِ بْنِ مُحَيِّصَةَ ، عَنْ أَبِيهِ أَنَّ نَاقَةً لِلْبَرَاءِ وَقَعَتْ فِي حَائِطِ قَوْمٍ فَأَفْسَدَتْ ، فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى أَهْلِ الأَمْوَالِ حِفْظَ أَمْوَالِهِمْ بِالنَّهَارِ ، وَعَلَى أَهْلِ الْمَاشِيَةِ حِفْظَهُمْ بِاللَّيْلِ " ، خَالَفَهُ وَهْبٌ ، وَأَبُو مَسْعُودٍ الزَّجَّاجُ ، عَنْ مَعْمَرٍ ، فَلَمْ يَقُولا : عَنْ أَبِيهِ.
Haram bin Muhayyisa narrates from his father: The she-camel of Sayyiduna Bara’ bin Azib (may Allah be pleased with him) entered someone’s garden and caused some damage there, so the Noble Prophet (peace and blessings be upon him) gave this ruling regarding it: “The protection of wealth (i.e., land and gardens) during the day is the responsibility of their owners, and the protection of animals during the night is the responsibility of their (the animals’) owners.” Wahib and Abu Mas’ud Zajjaj differed in narrating from Mu’ammar; they did not mention it as being narrated from his father.
